So... in an admittedly cursory review of that form:

... I see a provision for REPAYMENT of excess subsidy (Part 3, Lines 27, 28 and 29), which is as-expected. You underestimated your income... you are not eligible for all the subsidy... you have to pay it back. No news here. It's fair.

HOWEVER:
I see NO provision for deficient subsidy. None. You OVERESTIMATED your income... you were eligible for MORE subsidy... you are OUT money.

So there is the answer to the question.

If you OWE them, they want it. If they owe YOU, tough and too bad.

OK... now I'm ticked.

You are supposed to report any changes immediately. So for most people, it works...since if they lose their job, say, they can report the change when it happens.

If I reported my "change", it would zap me over to Medicaid.

I do not want Medicaid.

So... you are saying I should be happy to pay to stay OUT of Medicaid?

No no no. Not about "me" at all.

Tax-time was promised to be the equalizer... the time where your estimation was to be compared to the actual... and any excess or deficit was going to be calculated... and result in a tax payment OR refund.

I see the lines for tax PAYMENT.

I see NO lines for tax refund.

Explain to me how that is acceptable.

Yeah Bear, that's messed up....since you have retirement totals that give you the ability to purchase insurance from the ACA because you can. So you should be able to. IDK about the asset test elimination stuff for NY and how you qualify and/or don't qualify. Or why you should be on medicaid or not.

It's....strange.

I blame the Republican'ts for not letting us have single-payer system when it was proposed.
