The only place to buy the real BB is from Ben at AVE tho Bruce use to carry it at CloudsofVapor but not sure he still does. I think those cloneheads started when the AVE site was down for a long time and the vultures they are took advantage. This is the real thing.

No this is not the same, if someone made a clone recipe of boba's and called it something else that would be fine. The Smok tank is not called a Vivi Nova, that would be a trademark infringement (if it were enforceable).

Dude the Smok version IS called Vivi Nova.
Look at the first picture below that is the Smoke version of the Vivi Nova and it's packaging. The second picture is the Vision version and packaging. The ONLY way to tell the difference in the hardware is by looking closely at the heads. The Smoke version has a pointy tip and the Vision version has a flat top head. Tell me that is not flat out deceitful.

Alien Visions is the real deal, also called AVE around here. Have no idea how that happened.

Anyway, I'm pretty new to vaping myself and got robbed by Alien Vapors just a few days ago by this. I heard about Boba's Bounty from a friend and I knew the maker had Alien in the name. He told me it was hard to get so I was surprised when I was able to buy it no problems, from Alien Vapors of course. It was later that night my wife and I were talking about it that made me think I could have bought a clone. Sure enough I did. Lucky I only got 10ml, and it showed up yesterday. I don't know, it tastes like a damn Tootsie Roll to me. Still waiting on the AVE Boba's Bounty to show up, hopefully I'll get it today!

so does the real bobas bounty-just a better tootsie roll(at least to me)

The only problem with that would be that we couldn't say NOT to buy from them!

That's a bit of a problem, but those that buy it not knowing anything about it can't be helped, at least not until they come here, and those that look into it here can be told Alien Visions E-Juice is the only legitimate seller, any other vendor selling Bobas, Gorrilla Juice, or any other juice at the AVE site for that matter is not legit, excepting any authorized resellers, which should be listed in their forum and on their web site.

I stand corrected on calling it the vivi, i thought they were calling it the SRT. At least when I was looking at them, but it looks like they are well committed to the vivi nova naming. Chinese companies treat this a little differently, using "vivi nova" as a descriptor. In any event, hardware cloning is not really the same as this, but I'll concede the point since it's not the crux of what I was saying.

The main point is, while some countries do not offer good protections for trademarks, the US does and both of these companies are in the US. It should be fairly straightforward for AVE to deal with this.

Yes it would be straight forward If push came to shove legally speaking.
Alien Visions E juice - AVE (the one that produces the subjectively better tasting version) would lose the right to use the name.
Alien Vapors - AV ( the one that produces a nastier tasting version) registered the name Boba's Bounty.

What can be done about it is recommend the one you prefer.

Simply registering a name does not automatically grant you ironclad ownership, if another company has established ownership (as AVE has) they can dispute it.

This is to prevent exactly this from happening.

I felt it simply was about posting the fact that the bobas bounty spoken of in the threads and you hear about is the AVE version

so that new people don't end up going to the wrong site getting a different juice that taste different then the original
so they don't get a wrong impression about what this juice is supposed to taste like

which by they way if it were a clone wouldn't it have to taste like the original to qualify as a clone and not just use the name?

You're right. Just because the ghey dude in Florida registered the trademark doesn't mean he can keep it, especially if AVE can demonstrate that they had the name in commerce well before the registration. The site selling the nasty stuff would come to the court with unclean hands.

Not use the name. You can't sell a car made like a Yugo and call it a Chevrolet. You can't make a turd cake and call it a Little Debbie, and you can't make foul smelling, nasty tasting liquid and call it Boba's Bounty.
