vaping ban in NY state?

I have a friend that is moving to NY state next week and he is new to vaping and loves it. Is there already a ban there? Is it just buying and selling or vaping? If so does anyone have suggestions for me to give him, as he has not had a cig since I got him his first kit and I know he does not want to go back to smoking.

I think just the mall kiosks were taken away. I'm not sure to be honest. I haven't had any problems buying stuff or vaping in public.

The state assembly passed a bill banning the sale of electronic cigarettes. It went to the state senate but did not even get out of committee before they closed for vacation.

However, NY State did just close a huge piece of its budget gap by adding another $1.60 tax on cigarettes (plus sales tax on the tax). It goes into effect on July 1. A kiosk just opened a few weeks (or months) ago in the galleria in Middletown, NY (orange county). I haven't been to the mall in a while, but I keep hearing about it, so I guess it's still open for now.

i really dont see how ny is making a whole lot of money with cigarette being 10 bucks a pack. most people i know havent quit but have moved their buisness to the native tribes where cigarette really arent cheap anymore but are offered at a fair market value instead. 10 bucks a pack is really insane. so i really dont see if them banning e cigs would make much difference, since they have already lost their biggest chunk of retail taxes to the indian reservation.i think e cigarettes are really a small percentage of the nicotine usage around here, with the natives profiting the most off of ny states stupidity. the states keeps trying the threaten the natives with taxes but the natives refuse and they have been known the shut the thruway down. the ny state thruway runs through native lands. really the natives need to be left alone, and the price of cigarettes needs to go back down to 5-6 bucks a pack(still high if you ask me). that is what needs to happen if the government wants to reclaim their tax reveune and it would take away from the black market of the reservation.

i for one am getting really fed up with the government in ny state, they are nothing but a bunch of legalized criminals. they use the stigma of "health" to force the price of cigarettes to the moon. in reality they really dont want anyone to quit, otherwise e cigarettes would be recommended by the doctor and hailed as the greatest quit smoking invention ever invented. i would like nothing better than to see the entire government of ny state removed, placed in jail and replaced with sensable people that know how to manage goverment and balance a freeking checkbook. the also dont care if you die and would rather you smoke until you have a painfully slow death or end up in roswell cancer institue suffering through radation therapy.



so in short:
1. leave e cigs alone. if you must regulate, do so but leave nicotine levels alone so it remains an effective tool.
2. leave the natives alone
3. lower cigarette tax to a normal level. no one is buying at 10 bucks a pack, you not going to make any money on them

Hmmm, I signed up a while ago to receive email notifications when changes are made to NYS S7234 (the proposed e-cig ban). Well, yesterday afternoon I rec'd an email letting me know changes have been made. So I followed the link they provided, and it shows that 2539 words (basically the whole bill) have been deleted. There's a kiosk in the Galleria Mall outside Buffalo in Cheektawaga where you can buy ridiculously overpriced kits. I like to stop by and see what their pitch is then show them my bottom fed box mod and that it cost about 10 bucks to make. They do help spread awareness and I don't get hassled walking around the mall followed by a plum of vapor so I guess they have their place

i know of 3 e-cig stores in nyc....i've only been vaping for 10 days so i'm new on the scene and really don't know what's going on legally. i would think public opinion in nyc would embrace e-cigs since analoging even outdoors is frowned upon.....you really get lots of guilt trips while smoking in nyc streets....lots of exaggerated coughs at crosswalks especially during rush hour. There was even talk recently of banning smoking outdoors such as parks etc.

Another reason would be the significant savings for us here since analog prices are insane. Right before i started vaping, i bought my last pack of cigs in the city for $13.00 freakin' bucks!!!!!! I've been trying to quit analogs for yrs. to no avail, so when i heard about e-cigs i was enthusiastic in trying it. In addition to the health benefits, for me, a big motivator in transitioning to vaping was the ridiculous cost of smoking in these neck of the woods. I'm finally free of phillip morris and spreading the word to anyone who's interested.

i've been vaping in cabs and in the street with no problem....i even vaped during a therapy session the other day which was awesome. i really hope vaping becomes wide spread and big tobacco/gov don't get their hands on it....every time i vape, i feel like i'm sticking it to the man

As a fellow New York City-area resident, I am actually more concerned with what Mike Bloomberg will do locally with regard to e-cigs. I kind of think the state ban, which is a 50/50 possibility at this point, is likely to find very vocal and very powerful support in Bloomberg. He's an almost militant anti-smoker, and he's really made it tough for smokers in New York City. With the impending ban in parks and on beaches, as well as the growing popularity of smoke-free apartment buildings and condos, it will only be a matter of time before smoking is banned on sidewalks, too. And I have no doubt Bloomberg will extend that ban - just as Suffolk County did - to vaping in public places.

New York persecutes its smoking residents with the highest cigarette taxes in the nation and is now screwing its Indian reservations out of much needed income via tax-free cigarette sales. Vaping is a way to pay less to satisfy the craving to smoke. There's no way New York City or New York State will allow that to continue.

All the officials who are the most vocal opponents of e-cigs tout their concerns over public health. They claim the excess taxes on cigarettes are primarily intended to price smokers out of the habit and into recovery. But when a viable, safer alternative like e-cigs becomes popular, the truth comes out. The state and local governments make money on analogs, not on e-cigs. So while tobacco products are expensive, they're still available for sale and always will be.

Good news for the Native Americans in NY state. Apparently, the justice system does still work.
The Cayuga Indian Nation today won another court victory in its bid to continue selling tax-free cigarettes at its LakeSide Trading stores in Union Springs and Seneca Falls.

The U.S. Supreme Court today rejected a request by Cayuga and Seneca counties to overturn a recent ruling in which the state Court of Appeals sided with the Cayugas, lawyers for both sides said.

The decision settles once and for all the question of whether the nation’s stores are on a qualified reservation, said Lee Alcott, a Syracuse lawyer who represents the Cayugas.

Amen and Bravo! I am originally from central NY and their government is one reason I will NEVER move back there. I miss my family greatly and plan to move back to the east coast one day, but not NY.

Not participating in the government robbery was one of the greatest benefits to me too when I started vaping. I was smoking around 2 packs a day. It is completely immoral for the gov to be profiteering from peoples addiction. Especially if you consider that great many low-income people are being victimized.

BTW, I have never seen ecig store in NYC. Do you know where they are located?
