They can't stop you from breaking the law. That doesn't mean it will be legal to do so.
That doesn't mean they will enforce any restrictions. If DYI doesn't affect the sales
of the Market post deeming cigarettes and what's left of vaping, then there will probably
be no repercussions.
Thier goal is to crush vaping. Switching smokers to vaping is not nor ever will be a
viable long term money making proposition. They need new smokers just as much as we do.
When and if vaping reaches 100% penetration of the market there will be no hook to keep
one vaping as all new users will not have smoked cigarettes. Smoking cigarettes causes
dependency. Life time non-tobacco users do not develop dependency to nicotine. Clinical
trials have proven this.
When deeming is passed and down the road the taxes approximate or pass the
equivalent of cigarettes many vapers will go back to smoking. Not all will. Not all
are here on these forums either. Current and future smokers will see no real
benefit to switch as vaping will still be considered harmful but with regulated
and pure harm causing ingredients. Unless of course your BP and Big Medicine
who's harm reduction and cessation vaper products will be certified as safe by
the FDA the same as patches and gum. they'll make vaping both legal and
medicinal less effective too. What do you think controlling doses per puff is
all about.

No.

The FDA doesn't have the authority to write laws.

They can only regulate industry within their authority as the Food and Drug administration.

You cannot sell iron nails as food.
The FDA regulates what can be sold as food.
You can eat all the nails you like.

Really? What happens when you violate their regulations? Do they make you hold
your hand up and go sit quietly in the corner? The good news will be according to you
is the black market will be totally legal.

Who has the authority to regulate me?
The FDA doesn't.

Are we talking about the same country?
Where are you getting this?

If and until you show me where it states in the regulations now and after
deeming you are exempt I will agree with you 100%.
In the meantime go fly a plane in restricted airspace
and let me know how that turns out.
One cannot violate federal regulations with impunity. As a vaper right
now they have no say yet. Post deeming will be another story all
together. The Grandfather date is what it is. I see no intentions of
the FDA not complying with it.

Where in the regulations does it say possession of a device is illegal?

(It doesn't because the FDA doesn't have that authority).

I do not sell e cigs.
The regulations do not apply to my personal use of a device.

Did you bother read the link I posted?
Obviously not.

It doesn't now. What about post deeming? Remember you're the one
that insists your flashlight is going to protect you against overzealous
regulations if the hardware is deemed a tobacco product. Do you think
if the FDA regulates the hardware they will consider DIY hardware as
exempt? Do you think they will only regulate commercially available
products?

I've read some of the links, and tried understanding what is going on with the proposed legislation.
Basically, am i going to have to start DIY'ing? Because, honestly, i really don't want to go there. I'm leery of buying litres of anything, not to mention having to buy an extra freezer. Will i not be able to just buy any juice? Or is the US just proposing to tax the juice.
Or will i have to just buy vg at Wally World, and vape on that while i chomp on Nicotrol? I am really confused. And even my cats won't come anywhere near what passes for 'cooking' @ my house. Please advise :(

For the last time:

The FDA doesn't have the authority to regulate a DIY device..... Unless it's offered for sale.

You should do some reading because you are so off base with your information it's making me think you either just don't understand what you've read or you are just trolling.

It's hard to believe you really don't know better, or wouldn't at least google the info you are discussing.

Honestly, regardless of the FDA if you enjoy vaping you should look into DIY.

If you can mix a drink, you can mix juice.

I DIY and vape top shelf juice for next to nothing.
Better than shelf brand juice for pennies per ml.

I wish i could say you won't but every juice company has to submit independent lab tests and studies for every flavor. I've heard that each application is upward of 100,000 so if you have 10 flavors thats a million $s just for the application. Not including what the lab test will cost but if it doesn't get approved there out all that money. I just don't see many juice companies even trying to get approved.

Thank You, BadNinja and Skiball.

Yeah, i can fix a Bloody Mary, lol.

I think it is the storing of the nic that would become problematic.

Tried Johnson Creek when i was first starting vaping. Their Tennessee ?Cured was pretty good. The Vanda was like drinking a syrup. I think they make the juice for Blu. I wonder if that juice company, with a big client like Blu would survive?

I hope i can get nic storage sorted soon. Thanks Again!

That is how it is supposed to work. For a republic to function, it takes a president who will follow the law. After seeing the exemptions, extensions and deferred implementation of the ACA; watching the immigration law modification and lack of enforcement; observing the IRS selective use of its power; measuring the growth of the Code of Federal Regulations by several inches every year; the constitution is no longer the law of the land. I believe that the president with the agencies he controls is assuming kingly functions if not the title.
And it unfortunately takes a population who is willing to DO something about a government so out of control it circumvents and/or totally ignores and disregards the law of the land with impunity.

Johnson Creek no longer makes the liquid for Blu. They are now 50 % owned by Republic Tobacco. Blu is owned Lorillard.

In my opinion at least a handful of vendors will survive. Halo, Njoy, perhaps johnson Creek and MOV ... Hangsen and DeKang out of China obviously.

We slept...

Should have introduced a voluntary 'tax' on all stuff vaping, like 5% or so.
Global vape market projected at 3 billion bucks for 2016 ... five percent of that would make a decent war chest to do some influence peddling and legal battling in the vapers interest.

'Astroturfing' with $150,000,000.00 ...

Glass bottles with quality caps, minimal head-space, in your freezer. Extrapolating the feedback from people who started doing that 5-6 years ago indicates it should be usable for decades.

Not now. They will be if they are deemed a tobacco product. If you're not worried
about it,then why all the flashlight commentary? Simply build a unregulated mod.
People think the black market will take the place of many of our needs. Some
also think the OMB will kick back the deeming regs to the FDA for this reason
and others. Well this reason and others all get trumped by the safety factor
in general and the chillin' specifically.
I think you can agree that the FDA is trying a new approach to regulations
as evidenced by the draconian approach they have concerning e-cigarettes.
As any bureaucracy the FDA is seeking expansion and greater reach and
control. Deeming is a start of a new paradigm for them along with the
National and multiNational companies that are regulated by the FDA
for any reason. I believe if the FDA gets what they and the other stakeholders
want out of this it will not only decimate the vaping industry but,lay out the
roadmap for future conquests. Top to bottom control from origin to your home
of everything the FDA has jurisdiction over eventually.
I personally think the FDA with the acquiescence of the real stakeholders
intends to mess us up. There is an acronym for what I want to say but,
I believe it's against forum rules.
