I don't understand why they don't have to. How is it legal to ban (or regulate out of existence) something that might possibly be harmful but hasn't proven to be yet, and all indications so far are that it is not harmful? Anything on earth could be banned or regulated if there is no requirement that it first must be proven harmful.
There are federal laws demanding that regulatory agencies justify the cost/benefit of their regulations. FDA thumbed their nose at those laws. This is the basis of the lawsuits. But unless a judge issues an injunction -fast- there won't be an industry left by the time it is argued in court. So we are left waiting to see if a judge cares at all about that rule of law (among others brought in the various suits)

Nicotine will still be blamed for it all.
Here's how I see the future...

Big tobacco has a couple of cigalikes with "tobacco" flavor.
They will be taxed at a rate which makes them too expensive for regular use.

This is when the story of nicotine will change.
And Big Pharma will start rolling out their nicotine-based drugs.

Nicotine will become a good thing.
Smoking still bad.

Cigalikes too expensive and not covered by insurance.
And they are gonna spend millions making and marketing overpriced e cigs to get people to not buy them?
Big Tobacco will make a good little profit on cigalikes.

People will use them where they can't smoke, in their houses, in their cars.
They will have created the very dual-users they claim to fear.

Some people will even try to use them to quit smoking.
Although those people will find them to be too expensive for long term use.

Enough with the shady backroom deals.

The FDA is blatantly criminally corrupt and our current elected government won't do a thing about it.
