The FDA is going to hand down their ruling in October which will probably have detrimental effects on people that use ecigs. They don't answer to anyone except the Supreme Court it seems. They don't have to go through congress to get their rulings passed.

So, if congress can't do anything about their rulings, then what can CASAA do? Are they going to bring a lawsuit against the FDA? I've seen nothing about their proposed strategy on their website.

I guess I'm just looking for some light at the end of the tunnel.

From the CASAA website, here: The FDA & Deeming Regulations of E-cigarettes

Once the FDA has released its proposed regulations for e-cigarettes and other tobacco products to the public for comment, CASAA will review the legal and scientific implications of the proposal and identify points of concern and agreement. We will then issue a Call to Action (CTA) asking members to submit comments to the FDA. The CTA will include recommended talking points and a link to the FDA comment form. It's extremely important that as many members as possible of CASAA and the e-cigarette community submit comments to the FDA when the time comes. This page will be updated as more information becomes known.

On another thread, CASAA said it was scheduling a meeting with FDA to discuss this, but until the FDA releases the "deeming regulations," there's little anyone can do except closely monitor the situation. Once we know what FDA intends, THEN the time for action will have arrived.

If you want to support vaping and vapers, join CASAA if you haven't already (Become a CASAA Member), and support them financially if you're able (Donate to CASAA).

Correct me if I'm wrong.

But I thought that the FDA answered to the Department of Health and Human Services.

I'm a member of CASAA, and I've read that statement. But it appears that they're just waiting. Shouldn't they know what the FDA is proposing? And shouldn't they be working on stopping it already?

I'm not bashing CASSAA, I'm concerned that nothing can be done about the FDA ruling in October.

I wonder exactly how CASAA is supposed to know what FDA is going to propose, short of having a mole inside FDA? Frankly, I don't think FDA itself knows what it's going to propose. And if it does, it's certainly not broadcasting it to opposing interests!

Yes, this wait-and-see process is frustrating and nervewracking, and in my more pessimistic moments I wonder if the ANTZ and regulation-zealots aren't cackling with glee at the anxiety they're causing the vaping community. But no, my optimistic half replies, they couldn't possibly be that evil.... Could they?

But back to topic: Every day that the FDA delays publishing its deeming regs, more smokers discover ecigs and become vapers. Our numbers grow and this is a good thing.

Now if more vapers would join CASAA (and support them financially), the better able CASAA would be to work on our behalf. As I write this, ECF shows 19,374 active members. CASAA shows 4,800 registered members as of June 2013. Do the math... Anyone who reads this who isn't a member of CASAA, join now! It's free and takes just a minute of your time: Become a CASAA Member

It's not a "ruling" in October, it's a public release of it's intended regulations.

Members who attend the CASAA Member Meetings already know that CASAA directors are meeting with the FDA on August 26th to give our input. Whether or not the FDA will choose to disclose it's intentions for deeming regulations remains to be seen. (It's doubtful.)

But the process for this is already standardized: the FDA will publicly post what it intends to do and then give 30-60 days for public comment. That is what it does for all of its new rules and regulations. CASAA will likely know what the FDA proposes for regulation at the same time the rest of the world knows. It's then that the work begins opposing anything bad in the FDA proposed regulations. We will need every member to step up and voice their opposition in the public comments and support CASAA's Call to Action when it is released.

I would just like to quote this, because it really is amazing.
If you had told me three years ago that one day vapers would get such an opportunity I would have laughed.

This shows how far CASAA has come, and how much hard work they have done.

They could never have done as much as they have without our support.
But the more support we give them the more they can do.

At minimum support means joining CASAA, which is free and only takes 30 seconds...

Beyond that, there are many other ways to support CASAA such as donating...
Donate to CASAA

Or attending member meetings and finding out ways you can help...

To answer the OP's question.....I truly believe because of all the hard work of CASAA and the good people of this forum, as well as others, is EXACTLY the reason the regulations have not been proposed yet. I think it has been noticed by many agencies, vapers are not going down without a fight. CASAA and its members have had a hand in fighting all of this ridiculous county and state legislation. Additionally, when the White House asked for 5,000 signatures to acknowledge a petition, we gave it to them. When the White House asked for 25,000 signatures to acknowledge a petition we gave it to them and MANY more. Now we are to the point that we may have to start a petition to get the last petition answered! Thanks to everyone's hard work, nobody in the US wants a part of this fight! And lets forget, they lost once already in court! The best thing one can do to help is get involved in some way!
