Anything can be banned.
Pot for example was banned as follows.
They made a law that said you had to have a tax stamp to possess it. Possessing it without a stamp was illegal.
To apply for a stamp, you had to show you had some in your possession, thus being in violation of the law.

As it was a drug used predominantly by the African-American community at that time and when they presented their stash for stamping they were thrown in jail. There is a provision in the tobacco bill for menthol - based on same type of market trend - So if you are African-American and "they" say you need a "menthol stamp" in the future - Just throw it away or hide it - Don't go down there for a stamp -
