What legally defines an "e-cig"?

A city nearby where I live (Alhambra, CA) recently passed legislation restricting the use of "e-cigs" in the city only to places that allow tobacco as well. And today on the drive home I heard some more BS from the L.A. city council.

It got me thinking. What is an e-cig? Is it the nicotine? If I vape zero nic VG is it still an e-cig? What if I decide to vape zero nic juice in an area that is restricted and get a ticket? I can't see the city standing a chance in court if I fought the fine and presented them with the pure VG I was vaping, unless it's explicitly written in the law that vaping VG (or PG) is prohibited.

So, I guess I'm wondering what everyone thinks, legally, an e-cig is and what justifies laws affecting them.

That's the whole quandary :

It could use liquids containing nicotine. Tobacco contains nicotine. But so do tomatoes and potatoes.
It could use liquids without nicotine. Then the difference to an asthma inhaler would only be marginal.
But no claims are made that it cures anything. Basically you exchange the monkey on your back with a parrot on your shoulder.
You're ot smoking, yet you getting your nicotine fix.

In short, you could get a lawyer chiselling out finely crafted legalese at $500/hr and you'd get as far as reading through ECF at $000/hr.

But what it boils down to : E-cigs are a way of having the cake AND eating it , that's why so many folks hate us vapers - we've beat the system. We're still somehow addicted, yet we can continue to be so, without others (BP/BT/GVT) feeding on our addiction and without being miserable about it. And we've got a minimum impact addiction. Second-hand-vapour exposure risks appear to be negligible.
Compare that to other addictions and we come out smelling like roses, or whatever else you happen to have in your atomizer at the moment...
Unlike analogs, some of the stuff we vape actually tastes great. We're having fun and we broke the stranglehold and are thus denying others THEIR addiction, their drug :

Power.

Power, the most dangerous, the most destructive drug there is. Makes crack and crystal .... look like candy in comparison.

You're addicted to vaping. So? Worst case it puts a dent in your finances because you just can't resist the 'Buy Now' button for that shiny new mod. Fairly low impact compared to someone sideswiping your car cuz of drunk driving or blowing you our of your shoes while brainfried on some hardcore drugs. It pales in comparison those addicted to power and willing to lay waste to whole counries and even continents in their drive to keep it. Syria today, the 3rd Reich sixty or so years ago, take a history book and flip it open anywhere you like....

In one aspect we've liberated ourselves and that's why they're trying to throw the book at us - 'cuz just putting a million plus vapers into gulags isn't gonna stop it...

Let's keep it that way
