raging waters security said "NO SMOKING HERE!" i said im not smoking...its electronic...she continued to say ..."well someone got a ticket for smoking one of those things from the police here this morning"

i said ..well you know that not smoking? and i continued to vape. i told her that the police shouldnt have written that ticket and the person should fight it. I also stated ignorance of the law doesnt justify breaking the law. so if the police were really there then they would have consult the park manager about their policy on e-cig. if no policy exists then technically its not forbidden.. #winning! i love being a criminal justice major.

If they tell you "We're fed up. We asked you to stop, you refused. We want you to leave", then you're going to have to leave, whether they have a written "You aren't allowed to vape" policy or not. And if they ask you to leave and you refuse, they can have you arrested for trespassing.

I don't ask permission, I just use it. I try not to draw attention to myself, but I don't worry a lot about it. If I'm asked to stop, then I'll try to convince them. But just saying "Sorry, you don't have a written policy against it, so I'll do whatever I want" is pretty much going to end badly, so I don't see any advantage in pushing that far.

They can just say "You aren't welcome here, please leave", and you don't have any recourse. And they can decide "Fine, that guy was a .... about it, lets put it in the written policy". Better not to make a big deal about it.

I don't see much point in arguing with the security guard anyway. He doesn't make policy. If you want to effect a policy change, you have to move up to some type of manager.

I was told "No smoking" in a country dancehall by some barback/bartender/bouncer. I tried telling him I wasn't smoking, that there was no tobacco, he kept up with the "I said no smoking" thing. I then talked to the manager, and as soon as the manager saw my eGo, he said "Oh, you're fine, don't worry about it".

If the manager had said "I don't care, it looks like smoke to me, you can't do it", I'd have left and not gone back.

If I hadn't talked to the manager, arguing with that flunky wouldn't have gotten me anywhere.

I too live in NJ, and haven't had that problem at all. It's not illegal to vape indoors, don't let anybody tell you otherwise. If a manager or owner asks you to stop, in order to prevent smokers from thinking they can light up inside, that's a different story. But while indoors, don't be shy! Vape away!

;)

Actually it IS illegal to vape anywhere that smoking is not permitted in NJ. The politicians modified the smoking laws to include e-cigs.

I have vaped everywhere I wanted to. I try to apply common sense(for the most part). I wont vape near produce at the supermarket, but down the canned goods aisle Hell yes! I won't vape at my daughters school, but at my college campus, you betcha! I've vaped at bars, city hall, restaurants, casino's, even my local hospital.

Now of course I vaped at work. I work retail part time when not at class. Now I don't vape intentionally around customers, I wait until I'm alone or out of sight. But one day, a man saw me and asked about it. I showed him and explained it. He seemed extremely interested so I took him for a smoker. Come to find out he's my manager's barber and he ratted me out! Now I'm stuck with the bathroom and outside while at work.
