I can't believe that the one thread where the FDA is asking for comment before rulemaking is not front and center stickied as high as it can go while we have a stickied thread that has little more than propaganda (and much of that inaccurate) for our side and won't affect anything up there for all to see. Seriously. When a government agency asks for comment on rulemaking, IT IS THE PREFACE FOR RULEMAKING! That means they're about to say what they can (and they DO NOT need to pass new laws to do so...sounds odd, but that's how it is if there's not enough input to the contrary). This is where we get to have our say or decide to challenge it in court, and it goes WAY beyond the SE v FDA stuff we're looking at now. That original post should be stickied at the top of every board topic on this forum and every person who even thinks they have a vested interest in the issue should be commenting well before they sign the "online petitions" going on. The online petitions mean nothing in the real world. This means everything.

A lot of people probably think I'm the naysayer here and the newbie, but I'm not the naysayer and, while I'm a newbie to vaping and this forum, I'm not a newbie to the fight against over-regulation from the government. Been part of one that lasted 10 years in the federal court system based on a number of conceptually similar issues. I'm just the guy trying to say that we all need to fight not just harder, but one hell of a lot smarter than we are right now.

The FDA posted here asking for comments? I know a lot of us would have many things to say, and I do agree with what you are saying. Some of us have written the FDA. I'm open to compromise, and would love to give them my point of view. Sorry, I did search, what thread?

Thanks

Oh yea, I forgot, the FDA doesn't care about people.

Previously, at the FDA.gov site, I had viewed where they were taking comments until Jan. 4, 2010, however, after revisiting the site, it looks like public comments will be taken until Dec. 28th, 2009, providing this is the same legislation.
There are a handful of comments that are anti-e-cig. comments, and very few expressing a favorable opinion. Though I do see the comment by the Physicians for Public Health that was referenced here on another news thread. Providing this is the same proposed legislation, I would encourage everyone to leave a comment at "regulations.gov", do a search under "electronic cigarette" to see the proposed legislation on the docket and the current comments.
I'm sorry I can't post a link as of yet, so perhaps someone else could post a direct link.
I also see at the FDA site where they claim to consider public petitions, so, if someone has a well-crafted petition, I would be happy to sign it. I am not well-versed enough on the topics to present them in a meaningful way. There are guidelines at the FDA.gov site of what should be included in submitted petitions.

Well here is one. They want ideas on how to stop people from smoking. Too bad they want to ban one of the best ways to get people to stop. This one is still open for comment.

Regulation of Tobacco Products; Request for Comments

We are particularly interested in comments on the approaches and
actions the agency should consider initially to increase the likelihood
of reducing the incidence and prevalence of tobacco product use and
protecting the public health. Although the agency will not respond to
specific suggestions, we will consider them in establishing the new
Center for Tobacco Products and in implementing the Family Smoking
Prevention and Tobacco Control Act. In the future, we intend to solicit
public input on specific issues.

Regulations.gov

Maybe if the FDA idea guys and the banning guys get together they can come up with a solution.

And NO they didn't post here....nor are they asking for comments specifically regarding e-cigs. It is simply an open request for public comment regarding general "tobacco" regulation. Does not however make it any less crucial that we make sure to voice our opinion.
