2. I think the FDA deeming is a terrible action. Fundamentally it appears that they either started with a false conclusion (ecigarettes are bad), not really backed up by the science, or else are implicitly, perhaps unconsciously, working to restrict the marketplace to Big Tobacco (very few firms, especially the smaller innovative companies, could afford the PMTA process, which has no assurance of approval or required deadline for action).
Hopefully there will be legislative action to reel-in the deeming, at the very least one of the changes in grandfather date (February 2007 is a ridiculous cutoff date for vaping technology -- only very limited PVs were available then, and there is an open question of which ones were actively for-sale in the US at that time).
Equally, existing and upcoming lawsuits may help pull things back.
We need to push for the US to become familiar with the recent UK Royal College of Physicians report.
