Unfortunately, you're screwed. It's their company, they set the policy. Despite the fact that the policy makes no sense and is unfair to you, it's their company and they make the rules. Now, depending on which state you live in, a company may be able to fire you for no reason at all. I live in Texas, and it's that way here, as long as the company isn't using discriminatory reasoning as a means.
They always say the squeaky wheel gets the grease, and to some degree that's true, but if a wheel squeaks too much, or starts making legal threats, they get rid of the wheel and find a quiet one that doesn't cause friction. Anyone is replaceable.
Yep, the policy blows and seems that it wasn't thought out very well, but it's still their policy. As I'm sure your HR manager will tell you, if you don't like it, find another job. It's probably in your best interest to bite your tongue and vape off property.
