If Cali passes this ban I do believe it's time to revolt against a harmful government. I believe you should give the e-cig businesses time to regulate themselves first and if they are not able to, let the FDA make regulations because the FDA don't have any idea what they are doing. I can hear it now... The Government just bailed out the tobacco company because they are too big to fail... Yeah, Cali will ban e-cigs or tax the living crap out of it.

22955. Agents of the department, while conducting enforcement
activities pursuant to this division, are peace officers and are
subject to all of the powers and immunities granted to Food and Drug
Section inspectors pursuant to Section 106500 of the Health and
Safety Code in the same manner as are any Food and Drug Section
inspectors of the state department. These agents may take enforcement
action to halt the sale, distribution, or offering for sale of
electronic cigarettes
that can deliver inhaled doses of nicotine by
delivering a vaporized solution that has not been approved or cleared
by the United States Food and Drug Administration.

SEC. 4. Section 111247 is added to the Health and Safety Code, to
read:
111247. Any article that can provide inhaled doses of nicotine by
delivering a vaporized solution, including, but not limited to, an
electronic cigarette, shall be deemed to be a drug as defined in
Section 109925. This section shall not be construed as bearing on or
being relevant to the question of whether any other product is a drug
as defined in Section 109925 or a device as defined in Section
109920.
CAL. HSC. CODE § 109925 : California Code - Section 109925

"Drug" means any of the following:
(a) Any article recognized in an official compendium.
(b) Any article used or intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in human beings or any other animal.
(c) Any article other than food, that is used or intended to affect the structure or any function of the body of human beings or any other animal.
(d) Any article used or intended for use as a component of any article designated in subdivision (a), (b), or (c) of this section.
The term "drug" does not include any device.
Any food for which a claim (as described in Sections 403(r)(1)(B) (21 U.S.C. Sec. 343(r)(1)(B)) and 403(r)(3) (21 U.S.C. Sec. 343(r)(3)) or Sections 403(r)(1)(B) (21 U.S.C. Sec. 343(r)(1)(B)) and 403(r)(5)(D) (21 U.S.C. Sec. 343(r)(5)(D)) of the federal act), is made in accordance with the requirements set forth in Section 403(r) (21 U.S.C. Sec. 343(r)) of the federal act, is not a drug under subdivision (b) solely because the label or labeling contains such a claim.



CAL. HSC. CODE § 109920 : California Code - Section 109920

"Device" means any instrument, apparatus, implement, machine, contrivance, implant, in vitro reagent, or other similar or related article, including any component, part, or accessory, that is any of the following:
(a) Recognized in the official National Formulary or the United States Pharmacopoeia, or any supplement to them.
(b) Intended for use in the diagnosis of disease or other condition, or in the cure, mitigation, treatment, or prevention of disease in humans or any other animal.
(c) Intended to affect the structure or any function of the body of humans or any other animal and that does not achieve any of its principal intended purposes through chemical action within or on the body of humans or other animals and that is not dependent upon being metabolized for the achievement of any of its principal intended purposes.

I sent an email....I think that it is BS that the government has moved to jacking cigarette prices and alcohol anyway...who does that hurt....the people that already have money problems. Way to go Obama...I am starting to wonder why I voted like i did. (oh yeah...mccain...wasn't much of a choice)

This is the dumbest thing i ever herd of.. You can never ban a e-cig its just a electronic vaporizer., but you can regulate the sale of nicotine products if you choose to by selling it by prescription only.. that way u get the drug company's and doctors involved $$$ . O then you got from a cheap source of smokes to a very expensive and cost prohibitive product that makes smoking analogue cigs very attractive.. So California wants us to buy tobacco products and not replace them with very cheap e-cigs.. What a wonderful idea.. take something thats better for you and cheaper for you and drive it into the ground.. Good job California.. they deserve it .. California is full of those bleeding heart liberals ..

you are either very very new or a troll. you do realize that the fda is in the process of doing the exact same thing nationally? by the end of this week it may become illegal to import and sell e-cigs and e-juice, pending resolution of the SE vs FDA court case (which again should come this week).

As far as the bleeding heart liberals go... they tend to favor personal freedoms more than extreme conservatives. That's kinda the difference between liberals and conservatives (high personal freedom and lower capitalist freedom vs lower personal freedom and high capitalist freedom).

I think the "bleeding heart liberals" are the ones we have to beg to make this problem go away

You can't be serious. Lefties support more government control, oversight, manipulation and intervention in/around your personal life. Righties believe that the government should have as little control as possible over the lives of the governed.

I was Vaping at Knotts Berry Farm last night, well actually last night was Knotts Scary Farm.. But as i was saying, i was stealth vaping before getting on a ride and the ride attendent yelled over the speaker "NO SMOKING ON THE PLATFORM" and i quickly explained what it was. She smiled and told me to continue :) No one there complained one bit ;) seeing as how there were about 500 Fog Machines pumping out PG into the air anyways HA HA

@Þornbjörg : I suggest that you do NOT encourage people to state that the FDA is doing this at the request of Big Tobacco.

Whether or not this IS the case is up to debate. However this DOES make the writer sound a little tinfoil hat, if you ask me.

I would suggest that those that DO choose to write (you all should be) simply tell their stories of how this product has HELPED them quit traditional tobacco cigarettes.

Also suggesting that the FDA should continue their studies of the product as an alternative to traditional cigarettes and not as cessation tool can only help our cause. This is NOT a contradiction to the statements you have made above in the letter, as ANY product can be used as a cessation tool. It is just not allowed to marketed as one with out approval and over-site.

Here is my letter

Please veto Senate Bill 400.

I was a smoker for a little over half my life. For close to 15 years 1-pack a day was the norm for me. Even though I was an active smoker at the time, I supported clean indoor air acts. After all this was my habit, this was my addiction. Why should others need to pay the price for my convenience?

I now find that convenience is being used as a tool against the FIRST product that has given me some glimmer of hope in my fight to quit smoking. As I write this letter I have been SMOKE free for over a month. I have no strong urge to return to traditional cigarettes at this time. You maybe asking; why after only a month of abstaining do I feel this time is any different? I have tried all manner of cessation tools to quit and have NEVER felt that I no longer WANTED a cigarette. This is the very first product to give me such hope.

I find it convenience to use flavors as an argument to suggest that e-cigarettes are intended for children. I find it to be convenience to state that the devices have claimed to be cessation tools without thorough testing. After all, almost anything CAN be a tool to aid cessation.

Please ask yourself and your fellow members of state why a tool that has given hope to hundreds of thousands of smokers be BANNED without thorough investigation!
