Allow me to say it again, the company who holds said trademark, must enforce it. It is up to them and from the looks of it, they seem to have one target, iLLvapes. Like someone said before, if they were targeting everyone, why not file it all at the same time? Which brings us to "what did iLLvapes do differently?" Well they were trying to sell a product with another companies trademark. I don't think for one minute iLLvapes was the front runner in the marketing and publicity of these clones. Yet they seem to be involved with an infringement lawsuit. This is my observation and opinion, just as others have theirs, but my opinion isn't based off of what ifs and maybes. I feel its a reasonable assumption, but invite everyone to share their own opinions.

As I've said numerous times before, using the hana modz hologram sticker on the guts of the clone was just insane, IMHO.

I just re-read what you wrote. You are actually correct. Only Hana can use hana modz for their products. But all the sales were even labeled as Hana clones. So that is the violation right there. Hurray, we agree.

You need to calm down. This is a friendly forum and I have only stated fact. Current FACT is they are only suing illvapes. I don't want to speculate so my end of the conversation ends there. Are you a lawyer? All I care about is getting my mod and everyone else on here getting the same quality mod, without being misinformed or bogged down with irrelevant jargon. Your sarcasm is well noted, and you sir, are very welcome.

just to kind of verify this its kind of the same thing with candy crush saga taking every app with candy in the name to court but i think its going to be hard for them to trade mark the box i mean realistically unless they get crazy in detail with it but even then if the clones dimensions are off from the specs hana provided with the patent provided it the clones will be fine which is how lets say after marker car parts and stuff get sold with being 99% the same just one thing moved

And to add to that a "Cease and Desist" letter should have been sent to iLLvapes, IMO, as they were a re seller and made a dumb mistake. Did Hana Modz have to send one? Absolutely not. I just hate to see yet another company die off.... I also hope that all consumers, vendors and manufacturers (yeah Cloupor too even though they are Chinese, and American copyright holds no value in China) come out on the upside of things. We dont need to be dispersed as vapers in the time where we need to ban together and stand up to the proposed regulations....
DISCLAIMER: I in no way think ignorance is an excuse from the law.

There's no patent for the Hana, only trademark issues.....

I am also fairly certain that sent out cease and desist notes to all vendors to put them on notice that charges will be filed if they don't stop. This is unfortunately all very expensive, so there is little hope that the original Hanas will come down in price...
This is false. 122% on that. I know at least one has not been involved or contacted at all.
Anyway... can't wait for the hype to wear down too much what ifs, with no answers

Everybody should say what they want. We are all passionate about vaping. So sometimes we all say things we probably shouldn't be saying. But this is an interesting prelude of things that may come in the future as this is ramping up to be a multibillion dollar business. So please do not hold back when you feel like criticizing me. I can take it and also dish it.

someone/anyone please educate me......

My understanding from "patents and trademarks" when it comes to china made knock offs is pretty much "hahaha good luck". My curiosity comes when it is shipped to the US. Im guessing that US vendors/distributors can not sell these because on US soil it is "copied".

I guess what I am asking is, using the "middle man"(ele8, illvapes, eciggity, etc) where it becomes illegal? AKA can we order from alibaba/fasttech and not have a problem but if we order from a US based vendor DO we have a problem?

Sorry for my .... wording...Im drunk as heck right now.

From 101vapes update on the current status of the presale and expected ship times.

We have begun to get the Anah mods in from the manufacturer. So far we have received a partial shipment of Black and a very small number of Red just today.

If you ordered a Black mod and were in round one your mod is on it’s way. If you have not gotten tracking info for it yet you will have it soon. If you ordered a Black mod and are in round two your shipment has been prepared and will go out tomorrow, we will be sending out tracking info for the round two Black mod shipments as well.

We are expecting more to come in over the next week or two and will be sending them out the moment they get to us.We thank you for your patience and understanding. We will provide further updates if any of the details change..

Got this email today and lucky me, I ordered Black in the 1st round!

The mods are not the issue here. There are no patents being violated. The issue is simply that the vendors used the term or logo "Hana Modz" to advertise the sale of a box mod that is in fact a clone. Had they removed logos/names and simply stated that this is a 30W box mod, none of this would have happened.
