Wow is everyone doing chargebacks from illvapes now? Right after they got sued?


Like it was mentioned before, they were always quite shady, never upfront with customers even after I complained about their behavior, nothing's changed.

Elev8 are a great example of what any kind of vendor should be like, they work hard to keep the customers happy. With illvapes I always felt like they took my money and as soon as that was done I no longer matter. There is zero information regarding this situation on their facebook or website. Zero updates, not responding e-mails. Nothing.

can we honestly stop talking about trademarks and copyright law... we get it, there getting sued... lets move on already


With all the shops selling clones this could change the vapeing world as much as the FDA depending on how this plays out. More people buy clones than the real thing when they move up from egos or whatever.

Absolutely, not sure I'll get mine now. I emailed them asking if they would still ship as I was one of the first orders. If not to cancel and refund the order. hana modz?, more like Hana Barberra Modz. I called twice and got a busy signal. I'm doubtful they'll reply to my email at this point. They were aware of the law suit 05/16/2014 and not a word was said. I feel like a mushroom, keep me in the dark and feed me BS :(

Jumped ahead a bit, heck I could probably go watch "Days of Our Live" after not seeing an episode for 20 years and pick it up. :lol:

:lol: Sorry about that, but I can't keep from laughing on so many impatient people gathered in one place, roflmfao!!!:lol: Are you all newbies about the wait to vape game?? Even with the evolv chipset, there were delays, rumors, more delays, heck people are still waiting for dna30 devices. I was lucky that was on the first futura30 run, and had to wait like 8 weeks for it. New regulated gear has to be thoroughly tested and tweaked to insure proper operation. There are always glitches, set backs and unexpected delays all down the line. You are all spoiled by the instant gratification syndrome available to us now.

Anybody remember mail order catalogs?? Pre-orders are worse than FT, and we all know the delays ordering there. One makes an investment and forgets about it, and is excited when it arrives. I laugh on ones who demand a refund, and miss out when it does ship. They just further delayed their possession of this 30 watt capable mod.

Umm, after deep consideration, I've concluded the both and neither. Depends on the final outcome. But then that's life in a nutshell isn't it.

I suspect there would be those who would laugh at me where I hedged my bet by ordering another one from a different supplier. Heck, even if both turn out a loss or no show, the money was a low risk but high gain gamble. If the chip turns out to suck, well I'll just slap in a real dna30, so that would be an evol ana 30, or something like that. And I'd still come out ahead of the game.

Heck, wouldn't be the first time I was taken for as a sucker, nor likely the last. But then I dealt to a No player that dropped 1k in a few hours. Risk assessment and vape gain is what this is. Heck if bb,bt, and whatever. lol

You get better protections after you register it, but you get state and some limited federal protections for unregistered trademarks (Unregistered trademark - Wikipedia, the free encyclopedia). I think he could have sued them to stop importation and sale, but I think damages might have been limited to California customers. With federal registration damages would be nationwide.

Probably upon seeing the clones he filed the trademark, which was probably the smart thing to do.

Thanks. Still sounds like buying insurance after the fire to me. It has made for some interesting reading though. With all the clones coming out maybe Hanna knows they are done and are trying to cash out. Guess we'll find out one day. This could take awhile.

Heck it's less than two cartons of smokes. :D This is my first clone and my first pre-order. I'm going to ride it out awhile and see what happens.

It helps if you forget about the insurance analogy. It's not okay from day one to infringe on IP, it's theft no matter when it happens. In many ways registering a trademark is like registering a consumer product with the manufacturer -- that officially records you as the owner of that SN, but you own it whether or not you register.

So US law recognizes that and says you own the trademark when you basically create it and use it. This protects small businesses. Otherwise the entities with the most resources would wait around to pounce on trademarks the moment they become profitable. Or maybe even before.

Hana Modz's web site currently lists 33 USA dealers and 10 International dealers.

So in a way Hana is serving the interests of 33 other businesses in addition to itself.

They were charging some pretty silly money for their wares, I doubt they'll be able to sell at the price they have been once the clones are in circulation.

That way they don't have to spend the time dealing with 8000 people waiting for their mods or the 500 people (that did get one) with messed up mods. All you have to do is order parts assemble them and fix them. All of which can be done from a garage or small shop. I would say that cutting the griping down to 33 people would give you more time to do what you have to do. Can you imagine all these people that send 2 or 3 emails a day. That would take 4 full time workers.

I think Hana had no choice but to file a lawsuit. A cease and desist would of been better, but Hana pulled the trigger and now has screwed the pooch in my opinion. Hana is facing a large PR nightmare of their own making due to customer service circling the drain, a lack of mods for pre-orders, and the fact that B/M's have them for retail purchase albeit at a higher price than the pre-orders. Quality control is lax and the people who waited on the $250 device are getting ones that reset if bumped, turn off randomly, or have some major cosmetic blemishes. The icing on the cake was the Hana Modz sales via a vendor at Vapebash (I was there, 100+ Hana's were available). If I had been waiting for 2 1/2 months on a mod I pre-ordered and saw them for sale at a vape meet, well, I'd be freaking livid.

Either Hana grossly underestimated the demand for the mods and didn't plan accordingly, or they threw the dice and played the engineered scarcity game to keep the demand and prices high. If you lose that game, you're toast. Customers will just move on to something else (like I did - the Anah 30 watt clone). Technology changes in the blink of an eye these days, manufacturers who don't plan ahead get left behind.

I think there is something Hana Modz failed to see: Vaping gear has moved into consumer commodities, high power APV's are becoming more available and the downward price pressure has started. IBM lost the PC market when it refused to lower prices on it's systems, and then created an abomination called the PC Jr. Compaq stepped up and made PC Clones that were as good or better than the IBM PC's. The rest is history. Look at where most of the worlds PC's and computers are being manufactured.

Got a note from 101 vape that they have received a partial order and expect the rest with in a week or so. They have shipped the black ones from the first round and some to the second. They also got some in red, which I order but only a few so assume they sent those out on the first round as well. I'm in the 3rd round so expect mine about the end of the month or early in June.

Nice! How are you guys getting email updates? I haven't received a single update or reply...

The implication being that that vendor had somehow cut in line over preorders? Do you know for sure that vendor just didn't have his order in before whatever preorder you are referring to? This is the thing about dealing with distributors, distributors can do business however they like. If dealer A does preorders, dealer B orders for a vape show and dealer C does preorders, it's very possible that dealer B's mods will be for sale at a vape show before dealer C's preorders get filled. But nothing at all untoward happened.

Can we just stop with this already? It doesn't exist. No small manufacturer has the wherewithal to do this, they are lucky enough to have a mod that is popular at all. The truth is mod manufacturing, especially DNA mod manufacturing, is very labor intensive, and it just takes a long time to make a lot of mods.

US PC manufacturing died and took a lot of good jobs with it; that was not a good thing by any means. This is the ultimate end of allowing markets to be distorted by global outsourcing.
