So IF the FDA and the government come down on flavored e-cigarette liquid, couldn't we still sell it by just calling it a tobacco flavor?

For instance we could sell strawberry as "a mild but sweet tobacco flavor." I mean who is really to say it's not a tobacco flavor? People have different taste buds. Isn't all of this really just about the way it's marketed to stop kids from buying it? I mean isn't that the FEAR these people have?

I was just talking to my girlfriend about this the other day. Even if they do ban flavored e-liquid, it would be a lot harder to ban just flavoring. It is way too easy to DIY e-juice, so banning flavored juices will do nothing but add an extra step to vaping. Some people like simplicity and convenience, and I am one of them, but if I have to puchase slightly higher MG unflavored e-liquid and cut it with flavoring, so be it.

Yes, if the FDA somehow convinces the Secretary of Health to sign regulations that would ban flavored e-liquids, it would still be possible to sell food flavorings. However, there would be no need to incorrectly label it as a tobacco product since most food flavorings can be used in a battery powered atomizer like e-cigarettes.

You are right that the remaining questions are what it can be "marketed" as, but since the FDA lost their appeal to regulate e-cigarettes that don't make therapeutic claims as drug delivery devices leaving e-cigarettes as "unregulated" tobacco products like pipes, cigars, and other smoke-free products...this sort of workaround should eventually prove to be unnecessary. For now, manufacturers can continue to sell e-cigarettes as a smoking alternative as long as they do not market their products as a treatment for any diseases.

But how would anyone buying it know what it was supposed to be? :) You could have 'Tobacco #1', 'Tobacco #2', etc. but they are actually Gummy Bears and roast chicken flavours. I see the potential for problems to occur.

It would almost become like a universal unspoken, where people would buy sampler packs of juice to try them out. Then share what they learned (aka the true flavors) on forums like this. So long as the vendor wasn't spelling it out I don't see why regular joe's couldn't.
