We don't know for sure WHEN they will issue their proposed deeming order and regulations. Most recently they have said October BUT they have given us several proposed dates in the past 2 years and have not stuck with them yet so there is nothing firm about that October date.

After issuing their proposed deeming order and regulations there will be a comment period. We don't know how long that will be either, so its simply a guess to say maybe 3 months, and then they have to consider what comments have been made. That can take as long as they wish. After that they "can" put into effect a deeming order and regulations OR they can simply do nothing at all. Safe to say nothing is going to happen quickly but impossible to say how long it could all take.

You're getting way ahead of yourself.

First, they have to propose the regulations and open them for public comment. The proposals are supposed to be issued in October-ish. (The FDA hasn't exactly kept to any schedule about this matter so far.) Then the proposals have to be open to public comment. The comment time frame could be as long as six months.

Not even going to speculate what and when anything happens after that.

is there an ecig lobby that exists yet? cuz all i've seen in the news lately are negative articles about ecigs which are full of ignorance, like this article that was cobbled together by someone at Huffington Post the other day:

the public at large aren't familiar with ecigs or their benefits over analogue cigarettes, so they'll believe all the negative articles they see; which is just what the tobacco industry wants cuz they'd like nothing better than to make ecigs go away. the ecig industry doesn't stand a chance if they let this continue unchallenged.

Just looked at article and video and they had more good to say then bad but present it as its bad amazing

as far as ecig lobby yea look to blue cigg Njoy the largest ecigg co are lobbying for more regs to take out the competition because they do a lot of in store sales and don't need internet

I'm a little hazy on exact details, but I believe in addition to the public comment period, any proposed regulations also have to go to OMB (Office of Management and Budget) for economic impact analysis. (I also believe it's in their enabling legislation that they're forbidden to promulgate regs that would cause the creation a black market...) Don't know if the OMB just rubber stamps these proposals or if they take it seriously.

Yes, I believe the proposal has to go to OMB for approval before its published in the Federal Register. It could have several revisions between the FDA sending it to OMB and back to the FDA for changes before its publication in the Federal Register for proposal. All part of the reason why nothing is going to change quickly;)
