I'm curious...why do you think the lawyer isn't giving her full attention?? Not arguing, I want your opinions.

He can't exactly seek a final $$ settlement amount yet, she isn't finished with medical issues. She still needs surgery and physical therapy. No determination can be made by her doctor on permanent damage until after that. Isn't it premature to expect otherwise of him?

Sometimes an objective eye can makes us see things we may otherwise miss. So your opinions are welcome.

I was thinking more about the car issue. She should have gotten a new car before the woman that hit her got one. As I understand it, she is not going to get a new car and that just doesn't sound right to me. I don't know anything about TX law but here, if your car is totaled and it's not your fault, the other person's insurance reimburses for another car. If they don't have insurance you have uninsured motorist insurance then your own insurance pays for reimbursement and your insurance company goes after the person at fault.

I agree about her car, and do plan to bring all of this up to him and get more details about it from him.

In his defense though, I have to say that he calls her at least once a day since we retained him, he's given her cash out of his pocket for living expenses, he offered to front her the money for a car. He has personally visited the doctors that she and my grandson has seen since we retained him to get reports. I don't feel like at this time that he is not giving her or her case attention.

Perhaps, and I'm not making excuses for him, but maybe he is thinking that she can't drive atm, so other things about the case get more immediate attn. I do plan to ask that direct question to him.

Aside from the car question, I think it sounds like he is doing the right thing...never settle until you know what you are left with physically...she hasn't even had her surgery yet....there could be (praying not) much more....they can't do an open ended settlement.....settlement means it's settled, offer accepted...no going back.
(just a little note...every second he does something for her/on her behalf, talks to her, is billable time.....)

thanks for starting this thread. I hope that the swelling and pain in your daughter's foot is continuing to decrease. Great news about her knee. It is really unfair about the car, but it also sounds like the lawyer is really involved with the case (even if you do get another consult). Keep fighting, and let go of the things you can't do anything about (yet). Hugs, strength and warm thoughts coming your way.

Loving that advise!

Her cast is getting lose, that's a positive sign that the swelling is indeed going down.

She went to a friends wedding reception for a short while yesterday evening. She sounded like it did her mind set good to get out and have a little fun. She showed support for a friend's happiness, that always makes us women feel better. :)
