In its Dec. 20 filing the FDA requests that the full appellate court reinstate a stay of the preliminary injunction, pending a request for a rehearing of the case, the Journal reported. In the appeal, the agency also argues that the three-panel’s decision “rests on a clear error of law and will undermine” objectives that were laid out by Congress when it passed legislation that empowered the FDA to regulate tobacco products.

I let rip, i'm sick of skirting around the issue ...

The FDA already has the power to regulate e-cigs under existing tobacco legislation, this has all the teeth needed to keep them from minors. It just doesn’t give them the power to suppress the technology via a defacto ban, in order to protect the profits of big pharmaceutical interests. The FDA is complicit in a conspiracy to keep smokers on the ‘quit or die’ spiral that results in a pathetic (but very lucrative) 5% quit rate. e-cigs work, and are a safer alternative to smoking. That scares the money wheel that finances the conspiracy against these life saving devices, as well as their paid shills (ASH, AHA, ALA, CTFK, etc) all of whom stand to lose out unless the e-cig industry is swatted like a fly. Yes, i’m angry that people that are warranted to work for public health are in fact working in complete opposition to it. They are killing the very people they confess to be working for. Luckily the people, and the courts, can see through the deceit and lies.

Nice post planet!! I believe we need to continue to shine the light because most certainly the anti-tobacco/now nicotine movement and all their cohorts have shown quite clearly that they have NO shame and will continue to disseminate lies, fraudulent statistics and continue fearmongering until they get their way or are stopped by someone.
 
Somebody with funds needs to financially sue the FDA for "restraint of trade", (and no, I don't know if that's a legit suit).
They need hit hard in the wallet, as does the ALA, (lung assoc) with threats from multiple sources that donations will be effected and campaigns against them will ensue.

Only way is to hit em in the wallet and get politicians in line to back the industry. It has to be done as these e-cigs are sold...marketing/advertising.

    FYI, It is unconstitutional for the government to tax workers wages (w-2 taxes). The IRS lost against the supreme court to tax workers wages. However workers are still paying taxes and if you don't they take your house, they run like a mob.

    If you don't believe me look it up. There is no law saying you need to pay W-2 type taxes. the only constitutional taxes are on corporate gain and things like taxes on gas, beer, and cigarettes.

    Oh, the point of this post it to show that huge government agencies can really do whatever they want.

    I read an article abot the FDA and that new sweetener they sell at walmart. The sweetener has been around for many years but the FDA tried to stop it from being used in the states because of a request by splenda. That's why it's just now popping up on shelves. I have no doubt that all the negativity being brought on from the FDA is being caused by the tobacco companies.

The sweetener has been around for many years but the FDA tried to stop it from being used in the states because of a request by splenda. That's why it's just now popping up on shelves. I have no doubt that all the negativity being brought on from the FDA is being caused by the tobacco companies.

    There is no evidence that tobacco companies are behind the FDA trying to ban PV's. It is tobacco control groups and BP that are pushing for a ban. The main competition for NRT products are low TSNA smokeless tobacco and electronic cigarettes. They have much to lose if tobacco harm reduction becomes mainstream. Tobacco control groups would likely be heavily impacted or put out of business if smokers switched to reduced harm products. Those are the groups pushing for a ban, not tobacco companies.

    In USA, FDA is pushing for ban but in Singapore, e-cig already ban. Weird thing is that Janty ego and liquids are able to be taken back from TRU and HPB is definitely not involved here yet. Singapore is really a different country and Hard to say if they allow e-cig in general in near future but they are tell people FDA ban this but also mentioned that they don't care other country clinical trial etc. They say this and that. It seems government is just in the learning stage.
    Whenever our ICA detected liquid in parcel etc, They will send to HSA. But if it was Janty, they just release it. Weirdo

    Anyway I have no much craving over my pv nicotine now, but still I like my strawberry 0mg.

    It's all about money and control. If the FDA doesn't have control over us, they aren't happy campers. And just think, WE pay these idiots with our taxes to tell us what we can and can't have. I think everyone in the FDA needs to have an ecig and chill. All agencies lose when a person chooses and ecig. Hospitals, doctors, insurance companies, big pharma, big tobacco co., etc. It's time that the courts need to tell them enough is enough and if they show back up in the courts, that they will be fined.

    It all boils down to politics. The FDA may have a gazillion competing interests that are driving them down the road of control - but truth is - their "congressional authority" is being challenged. Their desire to hold power over products available is being sidetracked and that's like poking a stick into a hornets nest.

    If I ever get into politics - shoot me.

    the regulatory czars of this regime will win the battle at all cost, it is up to the little sheeples to vote them out and others in that will vote as the people actually desire no matter how long it takes, it is the only way to win overall and stop letting them think they know whats best for me/us. And keep telling people how it works, it help me.
