Employers these days can fire you for anything. I've had some very questionable terminations and when I talked to a lawyer they said "it's a right to work state, no point in me taking this case". It seems as if they only way you can successfully win a lawsuit for being fired is when an employer fires an employee of a different race while calling them a derogatory term for your particular family's origin. That's about it....

vaping isn't smoking, nor is it general off-duty conduct. He was arbitrarily singled out for doing the same activities in the form of vaping that other employees are doing while smoking. Not to be crude, but this is the equivalent of being fired for taking 5 minute bathroom breaks like everyone else but using wet wipes instead of toilet paper.

If this was really only about vaping then I would call a lawyer, but I'm stubborn like that.
