They typically do what they please. Package with them or not they don't even know.

Yes, they are not doing as they please so much that they are just doing some random catch in accordance to the law. As @chia said, there are some law on food colouring and flavoring by ava.

But I do agree with you that within the scope of the law, it is to their discretion on what they can do. Be it closing one eye and letting it go or being a jerk and catching every single thing that only bear distant relation to the law.

They cannot just make up any rules to catch people. They are catching people according to existing rules

Ok they arent making up rules, but they applying them in any old way they please thereby creating there own quasi-rules.

From what i can tell it is the tobacco/ecig import control rules they are using to seize regular flavor. Huh? What about some nice old lady doing some candy making, diy soda making or such like - she is gonna get a fright to receive a letter stating that her flavours have been sent to the HSA for proper disposal because they contravene tobacco/ecig regs and threatening a $5k fine. Poor old dear would panic.

Anyway we only got us to blame for being so open about what we do. I myself respect what the authorities are doing.

The letter is from HSA... its just a typical copy and paste template they use. Probably received about 4 to 5 of such letters already, all saying the same thing.
What they say in the letter is important. Even authorities need to follow the law. If it's under HSA, under what chapter and what act for the reason it is seized must be relevant. The only reason I can think HSA would seized it would be under the tobacco act (I could be wrong). If it's not tobacco, they only have a reason to believe and can't hold it where you have a chance to collect it, but need to come down to collect from them. If it's under AVA then it's a different story. (IMO from basic law I learn during my NS) and I had my experience in importing lasers and kattana that need me to come down to verify the items.

This forum has been on watchful eyes since years back, so long as you stay away from discussion on route and how and where, you should be fine except vaping openly and challenge the authorities

Newbies flouted rules and some mentioned about locations and mod had been warning yet no ones take heed of warning

Pics of mods are known without the need for us to take a pic of our prize mod. They have all info and knows how DIYs of juices consist of

Don't panic, when they say the flavour can be use for this purpose. They know this forum too well

It's double whammy guys.. 1st it may be 'related' to ecig and components, that's why they sent to HSA.. but bcos it's also a food component, they also may need to send to AVA for further testing..
So strictly speaking even if the flavorings are not for ecig purposes, still need to go thru AVA to make sure they are not hazardous to health..

But the HSA would probab just dispose of the flavors. E.g. the letter I received regarding a RDA seizure, which was actually from SingPost, said that they had forwarded the goods to the HSA for "proper disposal", and then reminded me about the tobacco control law and fine etc.

Why are guessing that he AVA is involved when the letter didnt even come from them? KurenaiX said it was from HSA? So Kurenai did the letter also say that the HSA had forwarded the flavours to AVA for further testing?

Nope, the letter was just from HSA stating that the item is infringing on Tobacco related laws (e-cig) and a reminder of the fine/penalty of flouting the rules. It did not state that it is being sent to AVA for further testing.

Yeah so nothing to do with AVA rules, just creative interpretation of the law. Too much! The good ol' ciggies are looking a lot easier about now
