Smoking everywhere brand has a policy of no refunds only exchange...
That is absolute ! If you purchase smoking everywhere e-cig you can never return for your money back if you don't like the way it operates that is too bad for you , they don't care and the kiosk owner or salesman will call security to ask you to leave if you insist for a refund. And the kiosk smoking everywhere brand owner can have you arrested for interfering with their daily operation and sales. I asked for a refund and the owner of the kiosk at the mall called security at the same time he said NO REFUND..He dialed the phone before i finished my sentence...And no it does not matter if the package is opened or not.
By the way mall security is very nice..LOL

Can you make a claim under consumer laws because they have made false claims about the product?

DC mentioned earlier that they cannot be smoked anywhere, that is the truth and if you've been sold them under this premise you might have a case. There is a difference between them not being illegal and being accepted.

Another thing that might be worth checking is how many cigs they reckon a cartridge is worth. If they say a packs worth of nicotine per cartridge then you could squeeze a cartridge and see how much they hold. If it's 0.5ml then a cartridge would need to have 20mg eliquid to equal a pack of light cigs. On the other hand if they measure a cartridge life by the number of puffs you could count the puffs in a cartridge. There's no way it will equal 20x15 (pack of cigs x average number of draws per cig). It will more likely be somewhere between 1-6 cigs worth of drawing.

Check for any other lies they might have told you like it's safer, healthier etc and nail them for false advertising, they have no proof of safety or health benefits.

Eventually the false claims made by sellers will be challenged by angry, disappointed customers. Smoking Everywhere are likely candidates for the first lot of legal challenges.

flaming nora. what a way to do business. like i suggested in another thread, if it comes to push and shove, find somewhere where you cant use an e-cig and then ask for a refund based on the principle that the product failed to deliver on it's promise. then the law is on your side, well it is in the UK anyway, not sure about the states. it might work though unless they have some kind of small print that says "actually you might not be able to smoke anywhere - it's just a brand name we thought was cute"

edit: fast-fingered kate got there before me. going to have to get a supplier to slip some tranquillizers in your carts kate ! (but she did make some other very brilliant observations so i might call the plan off)

Truth #2: By misrepresenting products, overcharging, refusing refunds, issuing flawed products and/or components, they are doing irreparable harm to our practice. The word of mouth will be simply: Damn things don't work! Wasted my money. For every person who finds our forum, 1,000 others will curse their own stupidity and seek solace in a pack of Camels.

This is the kind of exposure and publicity that we don't need. This is "mainstream" to be sure! But this only fosters a day of reckoning when these products come under regulatory scrutiny.

Thanks a lot, Smoking Nowhere. And, by the way, it isn't "smoking."

So true TB I was one who almost gave up the entire e-cig thing..I figured they were all junk..but then I gave it another try and bought a super mini rn4081 and it works way better especially when i use liquid..and now I just bought a black 901 from pure smoker and waiting delivery at this point..oops I am starting a collection...I won't even go into all my liquid flavors..LOL

I agree and disagree with your Truth #2 TB. You are right about some people thinking that they won't work, but the majority of those people are going to be in a demographic that doesn't use the Internet. People like my uncles would do excatly that. They would think to themselves that personal nicotine inhalers are impratical and garbage.

The other 90% of the population will probably get on the Internet and start looking around trying to educate themselvs on e-smoking.

The first time I heard of e-cigs was a few years ago when the first prototype had been created and tested. I believe it was on the CNN website. I had forgotten about it since then and the smoking everywhere kiosk is what reminded me about e-cigs.

Luckily, I always do some research before fronting cash. I had no idea that there would be a community centered around the practice of vaping. It didn't take me long to get enough information to make an informed purchase.

Like one of the posters earlier said, it makes sense to do things right from the start. Both my wife and I have determined that we can get off of analog cigs by vaping which feels like a better alternative right now. Since testing our first DSE901, I am about to purchase another DSE901 and a couple of pen styles along with some spare atomizers, batteries, usb passthroughs, and nic flavored liquids. I told my wife that I didn't want to be in a situation where I have to buy a pack or carton of analogs.

It is a shame that smoking everywhere doesn't improve their products and make an attempt to please their customers. I guess they perceive their customers as throw aways, kind of like their merchandise.

B-Boop.. sorry to hear Smoking Everywhere pulled one over on you too! :cry: We got our two 901 kits from Steve (puresmoker.com) in the mail today (our mail comes late, so am still doing the 1st battery 12 hr charges until 3 AM.. and going to stay up LATE so I can put our 2nd batteries in to charge.:thumb:) Got a bottle of juice too.. and did figure out how to refill the cartridge for the Smoking Everywhere.. and it has a little more "kick" with the juice (but just better than nothing) ... and can't wait to try the 901 ;)

My friend got an SE kit the same time I did [3 1/2 months ago] and still likes it! I let him refill off my collection of liquid, and he seems to get something out of it. Could be refusal to admit he was suckered for $150, but I think there is a legitimate difference in the way we smoke. He likes the deep, direct lung draw where I'm a "mouth-hitter" which seems to make a big difference. Possibly unrelated, but I'm about 90% smoke free and he's about 30-40%, so maybe not as much satisfaction there as claimed :)

At any rate he inherited all my incredibly overpriced SE gear... I've found other stuff that works now :)

It does seem that if they end up trying to lie about saying you can "smoke everywhere" -- hmmm -- their company name seems NOT make that worth the bother! ;)

The main company Smoking Everywhere web site states under cartridges:
"Each cartridge is equivalent to 20 traditional cigarettes"

I was hoping to use that "lie" to try and justify a refund.. but since the "employee" that sold it is being told by the company that they = 20 cigs? Just seems the best avenue is to just file complaints about Smoking Everywhere.. ANYWHERE we can. :cry:

Hi Mixxy, I don't know how consumer law works in the US but in the UK the seller is responsible for giving accurate descriptions.

Trading Standards officers can investigate dodgy claims and stop them trading immediately. Fines can also be issued.

When a claim is made about a product (eg a cartridge = 20 cigs or it is healthier) then that forms part of the contract of sale. If the claims are found to be false then the contract has been broken and you are entitled to compensation.

This is very clear in UK law and will come back to bite the bums of some of the less ethical sellers who claim health benefits etc. There is no medical basis for that claim and these quacks could be in deep water even if they don't actually harm customers.

Just think anyone doing a internet search about smoking everywhere brand electronic cigarette will come up with this eventually ..and can read all about the bad customer service no refund policy..Search engines all ways pick up on key words especially if they are in one sentence...I can only hope that more and more people keep up this post,and read thru all the tags.

I honestly don't know that much about the consumer laws here. It isn't often that we buy something here in the USA that can't be returned for any reason. I'm just hoping that filing complaints where I can (and assuming there will be many others) something can be done. I'm still working on what I want to say (needed to cool off a little so I sound rational ;)) so haven't filed anything yet. I want to go through the entire web site at Smoking Everywhere to collect info on any unproven claims they are making.

B-Boop - did you file any complaints against Smoking Everywhere?

I have had pretty much same experience. I bought 3 of them. (guy gave me buy 2 get 1 free at $99 each) so it was 3 for $200. Then $80 for all the cases/carts/Tax. I got home and it didn't seem to have much vapor. Like yal, I googled and found this forum. I went out and bought a 901 from puresmoker and his "True Menthol". Getting it 2 days later I was in HEAVEn. Actually preffered something to my Newports. So I bought one for my wife from thesmokelessshop.com I went to a computer show and worked with a friend who does them every week. I was lucky and sold my 3 smoking everywhere Cigs for $100 each. So I got my money back that way. Also presold 2 901's. So I thought this may be a way to make money. I then bought alot from a distributor in china. (2 to be exact) and a bunch of liquid. The liquid just wasn't even close to being as good as puresmoker's. But unfortunately he is out of the true menthol atm. So I have ordered liquid from 4 other places. Totally Wicked, JC, Ecigsales, litecigusa. That was thursday. I received my litecigsales one already. Smoked it, and it tasted GREAT also. But now a day later, no matter what juice I smoke, and no matter which e-cig I use(801, 901, 4072) after the first drag or 2, everything tasted burnt. Maybe I burned my tastebuds idk. Ok I am rambling, but I am doing a review of all the places I got liquid/e-cigs in a few days. I saw someone at a computer show that had one of the Smoking everywhere's and it actually seemed to work pretty good. In fact I couldn't talk him into trying my 901. So I contacted smoking everywhere(thinking maybe I got bad luck and the stores were bad ones) and they are actually going to send me out a demo one so that I can give a full review od it.

You know it's funny you mention that burnt tast, I had the same thing when I was smoking my PeeWee. I have a feeling it's the after taste that the Marlboro flavor leaves behind. But again I'm not sure.

Oh Boy I can't wait for the smoking everywhere review ! Make sure to do a video review with a full battery and their carts and give it a good actual inhale. So how did you get smoking everywhere to send you a e-cig kit (for free?) to do a review on this forum? and if you didn't like it ,and purchased a new 901 why would you review the smoking everywhere one?
