Hana Modz awarded $$$$ for copyright

I am shocked that Illvapes is handling this as it is.

Many businesses have a General Liability Insurance policy that covers them against various claims and losses. When shopping for a policy for my business, sexual harassment was my primary focus, but many (most?) policies provide coverage for Advertising Injury. Depending on the language of the policy, there is often coverage for copyright infringement, trademark infringement, and trade dress infringement (product design and packaging). Some have coverage for patent infringement.

I'm concerned that Illvapes does not have this most basic insurance, because they would have had to tender their claim to their insurer. The insurer - who would be paying the damages up to the policy limit - will appoint attorneys to represent Illvapes in the matter. However, Illvapes did not even respond to the complaint filed by Hana.

I am going to assume that Hana didn't exactly hire the top dogs, if their request for legal fees is under $8k. Illvapes would have had a fighting chance in court, maybe, if they at least showed up with attorneys.

Insurance policies exclude coverage for intentional acts. If they were knowingly selling clones as the real Hana product and got busted for it, that is not covered by insurance. Whatever the case, they didn't even bother to answer and lost by default. As Ninja stated, it will be business as usual for the Chinese cloners. But sellers better beware of using copyrighted logos and trademarks.

This injunction applies to this case only, but they are enjoined from "advertising, marketing, promoting, selling, distributing, or otherwise commercially using the designation “clone,” “1:1 clone,” “copy,” or similar phrase in connection with the use of the HANA MODZ mark,Hana Modz logo, and Hana Modz copyrighted content."

EDIT: After actually reading the link, he's awarded 300k. Man, that's the American dream, if I ever heard of one. I'll bet that's ten years worth of profit for him, if not more.


Awarded a judgement.

No vape shop can afford to shell out $300K.
This shop apparently couldn't afford lawyer as they didn't show up in court.
The shop will just file BK and Hanna won't get anything.

It was cheap *because* Illvapes didnt do anything. Which in some ways, since they knew they were going to lose ... actually limits their liability since they would have to pay the fees anyway.

Hana Modz are awesome They sell good equipment, will fix at a low cost, after warranty ,and is a REAL evolve DNA chip. The chinese do this. since when? They don't. How do you think they sell so cheap? .... made in America costs more. That is the reality of the market. That is just how it is. And those cheap ... clones have made a mint off of the Hana name.

Hana Modz doesn't sell themselves. They sell to others who sell to the consumers. Don't hate on Hana. Hate on the cheap Chinese clones that break and have no warranties.

Once you own a real Hana, then say something. Until then keep to your chinese made crap. Every mod I have owned prior to the Hana has broken for one dumb reason or another. Until you buy a real Hana or any real mod(not a clone) I would hold off on dissing them. I understand wanting to save money. I am a poor person but I have wasted close to $500 on cheap chinese clones and not one of them work right at this time.

I have had a real Hana for a year now and the Hana people have been awesome. Very helpful. I would recommend real Hana modz over anything on the market.

Maybe it is you, maybe it's me but, even the cheap 403 stick batteries I bought over 2.5 years ago still work as does every Regulated mod I own.:)
None are clones, but they are from china.

Let's not cloud the argument with statements that are simply not true. Hcigar has an authentic DNA40 for under $100 and Innokin has a DNA20 and they're coming out, or already have out, a DNA30, both authentic from Evolv.

Hana isn't special anymore, there's a lot of DNA devices available out there for a lot less than a Hana.

Just checked FT site,not a Hana clone to be found.

FT removed them long before the court passed judgment. For a while they had unmarked Boxes but sales were poor and they were discontinued. Buyers requesting higher power devices and of course plenty of China Branded mods.
(iSticks, Cloupor, IPV, Etc.)
