HC letter

Finally got a letter from Health Canada saying that my shipment got refused entry (after waiting over 2 months!).
Do they need to talk to me directly? Do I need to call them before they send the package back or they just don't wait for your call?
I don't want to call those mother ----"...:mad:
If you have any advise, thanks!

You shouldn't be receiving a letter from HC but customs???

If you have juice in your order kiss it goodbye.

If you don't then I would call them to point out no illegal activity has taken place IAW current regulations, and retrieve the package.

If there is juice in the order, I doubt that you will be able to negotiate the remainder of the package although I have read that some folks have received packages minus the liquid.

I am no lawyer, but the "package" could be deemed contraband, because you were breaking "the law" ordering it.

I find that odd I dont see how Health Canada would be involved unless it entered the country. Since technical it never enters Canada is should be customs that is sending you a letter.

Personally I always order equipment and juice separately. I have never had an issue with any order yet but I should be able to get the equipment through with little or no issue as long as it doesnt contain an e-juice. The shipment should have been denied not siezed so the vendor should have had the order shipped back to them. All of the vendors I have used will re-ship the package although you may end up paying an additional shipping charge.

From whom HC or CC and from where did ya place the order?

Health Canada....Report of Examination for Customs Entry

It was a bunch of cartomizers from the US.

But also this morning I recieved a big order from Tasty Vapor and my CHUCK....so I am still doing a happy dance.

Yes the letter was from Customs but on behalf of Health Canada (there's the HC logo on the header of the letter). Yes, my order did contain liquid and hardware. My concern now is more about waiting for the package to get sent back and re-shiped. I've already been waiting 2 months... That's the reason why I was asking if I should call them. Are they gonna wait for my phone call before sending it back or are they gonna send it back anyway? Honestly, I don't want to try to argue with those guys... :grr:

The shipment should be automatically sent back. However I do not know about what timeframe that has to happen in. You may want to give them a call to inquire about what the current disposition of the package is, maybe it has already gone back.

You are correct with a caveat.

The current ban in the States is for import, export and sales, of anything e-cig related. Which in my understanding can be stopped at the border and seized by FDA gurus, if they so desire, because the stay on Judge Leon's ruling from the appellate court has once again authorised the FDA through US customs to seize shipments, at the border.

Once across the US border, then Canada Customs only has authority to refuse access into the country of any nicotine containing product, and not seize perse. To date these have been returned to their origin as far as I can tell from what has been reported. It is also my understanding that packeges that have been inspected, were received by the recipient being fully aware the package was inspected e.g stamps etc... or note inside the package.

At present, many shipments that contain batteries are being refused exit from China. That is being done on their soil, by their Custom Agents, because of the refusal of certain carriers, to transport such packages.

Now we do not know all the different political angles being played here, but I believe one can safely assume that things will get much worse, before they get better. Seevral US vendors no longer ship to us.

An annecdote:

We do not know the pressure that is being applied in China wrt batteries etc... on planes. We also do not know if they have a current in house policy wrt shipping batteries etc... We also do not know of personal liabilities for vendors who circumvent the system or current regulation e.g that an illegal export has caused X damage to X amount of goods etc... that the carrier would be responsible for, but eventually the vendor if he/she has broken some law.

There is a lot of intangibles at play here IMHO and more than meets the eye or reported. However, reports are filtering through.

I feel your pain etc... but you have broken the law, not trying to be an ... here.

Only you know if it is worth your while to call them e.g you have a $300 order containing a mere $15 worth of nicotine. Then if it was me, I would try and negotiate (nicely) for the remainder of the package by playing dumb and keep/destroy the nic. For expediency sake, they have sent you a letter stating they have refused entry of your delivery, and are awaiting further instructions. Play dumb and tell 'em to RTS so you can be refunded ASAP.
