Do you have any other tubes the kick will fit in. Do have any friends with a battery tube the kick will fit in? Eliminate every thing else that could be a problem. Are batts good? Is the connection good? Is the atty good? If everything else is verified as good and the only thing left is the kick, then it is the kick.

Is the cart pushed all the way down flush in the connector?? if it is you can adjust the pin on the connector up with a jewlers screwdriver. The cart might be touching the top of connector and shorting it out.Is the kick settting flush on top of the battery?
Did i read your post right, you are using a 16490,16500(18490 and 18500) batt in the legacy???Have you tried adjusting the throw on the switch by adding the supplied washers, one at a time. The switch might not be connecting.I know i had to add washers to mine.

I just tried backing out the pin as the cart was touching. When i screwed the top back on the kick fired the cart(working) as the switch was set for the 18650's. I took it apart and reset the throw and it is continuing to make the tic-tic-tic noise (from the kick itself).
Do you mean it is making the noise that the kick produces if the battery has reached its low level cut off of the kick??? It will make the sound you are describing when the battery level falls below 3.5v i believe it is.Have you checked,or have a way to check the charge of the battery??

EDIT: you can get around this by just re-inserting the battery and it will reset the kick for a short period of time but i would not suggest to keep doing this.
