Is it possible that our Human Rights are being undermined?

Is it possible that our basic human rights are being blatantly disregarded by law makers and politicians? Can this be a way for us to litigate against those that are trying to or have already taken one of our basic human rights away, The Freedom Of Choice? vaping is after all a Human Choice is it not?

I would be very interested to know what your opinions are on this issue.

Just a foot note that I am generally not politically active, but I believe in our ability to continue with what makes us all happy....vaping :)

I don't know the first thing about the law in Austrialia. In the US it is unconstitutional. However, the constitution has been walked all over so many times that it's become a joke. So many people were willing to let it be chipped away bit by bit and always for some good cause of course, that it's common now for unconstitutional laws to never be challenged.

IMO I think blatant disregard is a requirement to be a politician. I don't think they could do their job if it wasn't. Ignore the important stuff, raise money for you're next election and promise to do everything that you ignore. Maybe thats a simplistic view...but it's mine and I'm stickin to it LOL

I have found a link to the The Constitution Act of 1975 and I think it is primarily for the State of Victoria although there may be Constitutions for other States elsewhere.

HeatherC I tend to agree :) but seriously, if our vaping is a part of our culture, as it definitely seems to be, can they take it away from us based on the Human Rights aspect? Can we fight against them using Human Rights as the basis for acceptance?

Off Topic: - Did I happen to mention that I am still waiting for my first real Vaping Starter Kit to arrive? :) I am sure customs here in Melbourne have seized it and are happily vaping on my most vaporlicious juices as we speak.... lol

I ship guitars all over the world and the most corrupt nations always seem to make people pay a bribe to get their guitars and stuff. It's funny though the bribes are often less than the customs fees for some nations. I have shipped several old Fender Strats to Austrialia, it seems that they are in very high demand. The guitarists not only pay top dollar but very expensive shipping as well. But I will say this, they seem to always pick the really good ones.

I didn't know that, but then again I don't know that much anyway lol..I am however, an amateur guitarist and can relate to the bigger spends for a good strat :)

Basic Human Rights. I only know of two.

You have the Right to be Taxed.
You have the Right to Die.

Not sure of many other rights that were given to you when you were born.

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.

We have no rights in the eyes of today's government. We are merely "workers" who are to be herded and controlled for the "Greater Good".

As long as we continue to produce and consume, and don't make any REAL stand, governments are indifferent to us... and tobacco is a big money maker.

SO MANY people support all the little things that lead up to the ultimate dissolution of our freedom, seat-belt laws, smoking bans, health insurance mandates, alimony, drug laws, anti gay movements, sodomy laws, anti prostitution laws, anti gambling laws, tax shelters for the rich, gun controls, and on and on and on... But then the minute something begins to have a direct effect on their own lives they wonder where it all went wrong? I don't get it... Someday people will wake up and realize that we were not meant to be slaves and we cannot allow the ILLUSION of safety to infringe on the freedom we were born with.

As long as people continue to vote for (or sit at home and not vote against) laws and regulations that legislate morality, removing freedom in the name of safety, religious belief, righteousness, and the patently ridiculous notion of the "greater good", we will continue to become less and less free (not that we have many freedoms left).

The constitution is a document of Negative Rights, as in outside of those granted to the federal government all others lie with the states. The fed holds the highest power but those laws that stand outside of that implicit in its writings are fair game for the states, and there in lies your local laws for smoking bans, seat belts, gay laws, gambling regulations, and even more etc etc.

Sorry, but thats all constitutionally sound. Instead of holding the document up as a paragon of virtue perhaps it is high time to expose and correct the inherent weaknesses within its wording and intent. No document is immune against the passage of time and change of society. Perhaps like so many other nations a complete rewrite taken under popular non-electoral vote wouldn't be such a bad idea.

The drug laws arise out of the federal governments constitutionally granted right to police and control international trade. Again, its all legal within the wording of the document.

Im just musing here, i know to many people favor the current bent and fractured system to allow such a populist and majority 1-1 vote counted event ever take place.
