Ebay is not banning it... It is an illegal item, as are bongs, cigarettes, drugs, needles, porn, etc...

Illegal for sale on Ebay, as the TOS dictates.

All ebay items should be items that can be purchased by people of "All ages", and should not be listed in areas where the item is not allowed for sale.

This includes poisons, tobacco items, and items marketed as being related to illegal drug or controlled drug consumption.

Sure, you will always see people selling that stuff... until they get flagged and lose the account. It doesn't take much to create a new account, or convince some other individual that it is legal, and have them loose their account. (Like the guy who posted about drop-shipping, instructing people to sell items on ebay and craigslist... what does he care, it is not his account that will be lost.)

___________

Not allowed:
Items that contain tobacco (cigarettes, pipe tobacco, cigars, smokeless tobacco, herbal tobacco) intended for consumption

Cuban cigars that don't comply with both our tobacco policy and our embargoed goods policy

Adult-only = (Available to 18+), this is one of those limited and "Not allowed, adult items". (Not even in the misc section.)

Just because it has not been removed yet, does not translate into it being legal. (Legal as in... allowed by E-Bay, not legal as in by the government. Just because the government allows it, does not translate into e-bay allowing it.)

I work at Musiciansfriend, and Ebay is on the second floor, and I socialize with some of the ebay employees. E-Cigs are indeed banned from them. But I'd much rather purchase from a good supplier like some of the ones on the forums. Don't think I'd much trust homebrew liquid sold on e-bay, I'll just make my own.
