But here is the LOOP HOLE ... does mods look a Regular CIG i dont think so so the MODs dosent look like a cig so i say Vape On in KY.. i live close to the Capital and will go Vape on the Capital Steps if i have to.. I have smoled for 35 yrs and resently started the vaping and now only about 3 Anilogs aday and i breathe so much better now and i ever have a treakostomy and have lung problems ...I think god everyday for Ecigs they have saved my life..

Hey mlinky, you should definitely forward this on to your representative.
It has to help if he thinks he is not going out on a limb with no precedent.

The Virginia opinion doesn't apply, and neither does the appearance of the device.

Problem with the Kentucky legislation is that it includes

(3) "E-cigarette" means any electronic oral device, such as one composed of a heating element, battery, or electronic circuit, which provides a vapor of nicotine or any other substances, and the use or inhalation of which simulates smoking. "E-cigarette" includes any such device, whether manufactured, distributed, marketed, or sold as an e-cigarette, e-cigar, or under any other product name or descriptor;

AND

(10) "Smoke" or "smoking" means:
(a) The inhaling, exhaling, burning, or carrying of any lighted or heated cigar, cigarette, hookah, pipe, plant, or any other material intended for inhalation, in any manner or any form;
(b) The use of an e-cigarette which creates a vapor, in any manner or in any form; and
(c) The use of any oral smoking device for the purpose of circumventing the prohibition of smoking in Section 2 of this Act.

Wow. I feel for everyone in Kentucky. You've got some really creative legislators. Redefining smoke as ".. any other material intended for inhalation, in any manner or any form" and stipulating ".. the use or inhalation of which simulates smoking..".
Certainly covers mimicking cigarette use while sucking air through a straw quite well.

Perhaps you should lobby for redefinition of the state legislature as "the south end of a north-bound Derby horse".

Seriously wish I could help but even though it could be another legal precedent domino, hearing from non-residents might just drive them further down their rabbit hole. Take a straw with you to the hearings. :p

Hey all... This isnt good. I have been trying to organize a get-together of Lexington area vapers, and we cannot find a single establishment that doesnt consider vaping "smoking" and will not allow it in thier site. This is just silly. One of them even said the fragrance from vaping can be offensive. I told them.."do you allow women/men with strong cologne/perfume in your establishment? Because I have found some perfumes more offensive than any vaping, and there are proven cases of people with allergies to perfume".

All of this is just silly...we have gone thru 30 years of villification of smokers (in my mind rightfully so...and I was a former smoker that NEVER smoked in my house, or in a resturant). So now anything that "looks" like smoking must be just as evil in thier minds.

FAAmecanic, although everyone has their own comfort level, you may wish to try this:

If you're planning to eat/drink anyway...

After being seated,
  • Ask your server, "Is it alright if I use my vaporizer?" [I've never received a "no" on this.]
or
  • Ask to see a member of management. Ask the manager, "Do you have a policy on personal vaporizers?" [I've never received a "yes" on this.]

If you receive an "anti" response...
  • Find out why they have such a policy.
  • Correct all the misinformation.
  • Demonstrate your device.
  • Leave literature and CASAA contact information and/or your own contact information.
  • Apologize for being unable to patronize their establishment, but you cannot encourage any business whose policies are based solely on appearances and/or lies that could ultimately prove deadly to over 20% of Kentucky's population.

Most Important: BE POLITE (please)

You know what's funny? Alot of the legislators here in KY vape e-cigs! I mean wth?! And an establishment in Frankfort will definitely let us have meetings. People in frankfort dont really care it seems. My boyfriend vapes EVERYWHERE and ANYWHERE. He doesnt care. :/ He actually works at the Capitol...i used to. I will see if he can talk at least 1 legislator into being in favor of it! I am actually writing my ethics paper on E-Cigs vs. Tobacco Cigs....any ideas of what website articles i can use in favor of e-cigs???

When I click on the links within the posts they open up just fine.

Are you trying to copy/paste the links as they show up on screen? If so, they don't translate correctly, because the forum software truncates what is displayed on screen. If the destination screen has Title stored in the HTML code, the forum will display the Title instead of the URL. And if you copy/paste that, you won't get the URL...you will get the text of the Title.

I have found that if you post a link, and then you edit the post, it is possible to force the forum to display the full URL.

At first I would ask, now I just use it and don't say anything until someone asks what I'm doing. Lol hubby and I vaped all through Walmart tonight, we got a couple of strange looks but most people dont even notice! We are in a very small town so most people around here know each other and alot of people, including the police around here know about it and doesn't bother us about it.

Harrodsburg has the I won't bother you, you don't bother me policy. Lol
Most people in this town know us from computer work and such and look at us a "electronically advanced"
so I guess they aren't surprised to much.
