It is indeed disheartening and frustrating to hear that the FDA will intend to make law its draconian deeming regulations. With the 'royal assent' (as we would say in the Commonwealth) being August 6 2016 there are roughly 2 years and 3 months of usual uninhibited trading and product innovation remaining. I doubt the FDAs legislation will stick but as they say 'hope for the best and prepare for the worst'.
Having initially thought that the deeming regs would come into effect on the deeming date in August 2016 I put in a significant order with NET.com. I asked Clay in email what his policy would be during the period leading up to the deeming regs becoming effective and he advised that they won't come into effect until 2018-2019 to the best of his understanding. Clay is indeed worried about how the deeming regs will affect his business given he has put his heart and soul and staked significant financial investment into his business. However it sounds like he intends to forge ahead until the very end.
Clay, being the ethical and considerate vendor he is, gave me an opportunity to cancel my panic order but I told him to process it anyway. He has a slew of new cigar, pipe and hybrid NETs I am keen to try. Raven, mystique, oak cask and several others.
In the meantime Diane of MyVapeJuice sent an email to everyone on her subscription email list advising that her store may close any day now due to VISA cancelling her merchandising credit and debit card facility as they consider her to be trading in a tobacco product which is unlawful without a tobacco license. This illustrates that the laws in the U.S. are already having an effect.
My attitude is that if I have some favorite liquids or vendors I will put in an order. You never know when your favorite vendor will lose heart and close shop, a law prohibiting the sale of NETs will come into existence in a state or like MVJ, a crucial constituent in the business' environment will cease providing an important service which will result in the business grinding to a halt.
In terms of my personal approach to the deeming regs, I am fairly lucky. My compulsive spending nature means I have plenty of liquid in the fridge and I know from experience that a NET kept in the fridge, preferably in glass bottles will last 3 years.
Being in Australia means I can still order new innovative products from Chinese companies and liquids from China, the Philippines, Canada and the UK. I'm still not clear on whether Americans will be able to import liquids and vape gear abroad.
In any event and despite non Americans being able to order vape gear from other countries, the vacuum left by american juice and vape hardware will be catastrophic, particularly for us NET Vapers. Every single one of my favorite NET vendors operate out of the USA and while China may be doing wonderful things with hardware their main impetus is the American innovation. Their mod chips tend to be modelled after USA chips. Without the American innovation and technology China is left high and dry.
