Know thine enemy - but you don't have to emulate him.


Kristin--it may be "popular" to bash him and if that is what you want to do--go do it. He has been around almost as long as you have been alive and is well respected by many. I do not know who these "peers" are you refer to, but whatever you what to call him, he is effective.

By the way - I wasn't just "bashing" him. The man does know his way around a courtroom and it's a good example of how getting a motivated attorney on your side is beneficial.

But that man cares nothing about the issues he "champions" nor the people it affects and often does more damage than good. Banzhaf's own statements have made it clear that he's all about the mighty dollar.

I will show him no more respect than he deserves.

I think you give him way too much credit, Sun.

Unfortunately, age does not always equal wisdom.

He had one big win many years ago - getting ad time for anti-smoking messages - and has pretty much claimed the credit for other people's work and brought frivilous lawsuits that were dismissed since then.


It speaks for itself. If he was not effective, you would not be discussing him right now. Read some of the cases he has been involved in. You do not get cited in Supreme Court Decisions unless you meet the standard. He was even referenced repeatedly in FDA v. Brown. So lets not go off the deep end about how he is some kind of nut job that no one takes seriously.

Bottom line he is a dangerous player in the game.

While I won't deny that he is a thorn, there are a lot bigger players than Banzhaf.

He's lost case after case in the food wars. He blows more smoke than the cigarettes he fights - threatening lawsuits over toilets, fast food and ice cream fat.

Here is the letter I sent to them:

NY Assembly A9529 - Banning Electronic Cigarettes

I am utterly shocked and appalled that the entire New York State assembly would outright ban all sales of a product based on heresy with no scientific facts behind Linda Rosenthol's (approximately) 10 second-long description of electronic cigarettes.

I believe the chemical she is referring to 'as being used in antifreeze' is Propylene Glycol. This is used in modern antifreeze as a safer alternative to the chemicals that were previously used that were very toxic. PG is also used in many ingested products including baking extracts, candy, asthma inhalers, cough drops, skin care products and many other products many people put inside/on their bodies every day and can hardly be referred to as a "carcinogenic".

Electronic cigarette "juice" often contains Propylene Glycol and/or Vegetable Glycerin (sometimes used in combination), nicotine and flavorings. This is a very small list compared to tobacco cigarettes which contain over 4,000 carcinogens. The only carcinogen in this list would be nicotine.

I agree that nicotine products should never be sold to children, but the rest of us should be able to make our own decisions as to what we put in our bodies, especially when they are clearly SAFER than cigarettes. Had she proposed a ban of selling these as "smoking cessation devices" rather than "nicotine delivery systems" it would be an entirely different story.

What would this country come to if all suggested statutes were passed in this manner with vague, inaccurate ten second descriptions, literally no explanation, scientific proof, or at the very LEAST expert consultation? Pretty much all consumer products and even the air itself could be banned. Everybody who voted in favor of this ridiculous bill should be embarrassed and ashamed of themselves, not only for failing to ask for reasonable proof that these products should be banned but also for being UNAMERICAN for removing another portion of our civil liberties.

Can you confirm where you got this information? I don't see ecigs mentioned anywhere on either of their sites. DiCaprio has been photographed with an ecig in his mouth before- which has subsequently been used in marketing for multiple companies. I wouldn't assume that as a credible source, as that photo was taken over a year ago, however if we have some sort of tangible evidence that either DiCaprio or Tom Petty are currently using ecigs- this might be a viable option to use their celebrity prowess in a campaign.
I could get a hold of either of them if need be, but want to make sure I have the necessary background information regarding their current ecig use- as I'm sure DiCaprio's people are aware of his image and name being used without authorization on plenty of these scam sites. I would see DiCaprio being a viable option as well, provided we can verify somehow he is currently still using ecigs, or at least experienced positive benefits from them, as he is very involved in advocacy issues regarding social, health and environmental issues. If spun right, he might be the celebrity we need on board.
(By the way, please don't site any press releases as credible sources if they're written by a company- as that's all false marketing)

Here is a whole list of female stars who smoke, sorted by analog brand;
maybe if at least one or two would joicn ECF and sign the petition and wish to switch to electronic cigarettes it would help.

(I don't know how often the lists are updated tho, and I have also heard that many famous people do or have tried electronic cigarettes. Some have probably already quit smoking the hard way?)

If they ever come up for ban in Arizona, maybe I can get out there.
That would only be a four hour drive, as opposed to a nine hour drive to Sacramento.

This is the only time I ever regretted living in the bottom left corner of the country.

Wow the government is really starting to overstep its bounds to decide what adults are allowed and not allowed to do. Its ok to smoke a real cig that's chock full of those same chemicals that they are complaining of? Yes, ban the sale to minors, regulate it in that way, but there is a long standing bill that prohibits the banning of cigarettes; e-cigarettes should be protected under that same bill.............oh but they don't get their $2 per pack in sales tax huh? Money really is the root of all evil
