My daughter's last apartment complex had the same rules..she had me look at it to reassure her it was not aimed at PV "vapor" but more so the "Snoop Dog" crowd's new line of e-cigs. It was a liability issue having tennants with "other electronic cigarettes that emit smoke" 'round the pool, on the patios, hallways, etc.

Couldn't they just say "No Drugs" in the common areas?

Im not understanding where the problem is here. Are they watching you via closed circuit television? Just vape in your apartment and not in any common areas. If anyone smelled anything and happened to inquire tell them they are smelling your breakfast you just finished eatting

Now I understand why FDA wants to ban all flavors except tobacco and menthol. Menthol pie anyone?

Just about every rental I ever lived in was non-smoking, even houses. It's either that, or you replace the carpet/paint the walls with every new tenant, which just isn't cost-effective. I was an outside only smoker anyway for most of my smoking life, so it wasn't a big deal. And yeah, sometimes I broke the rules if it was super cold outside, but otherwise not. I have a rental property now, and no, my tenants are not allowed to smoke inside. They can go outside, onto the nice porch, just like I did when it was the house that I lived in. I'm sure they break the rules sometimes…which is fine, just as long as it's not 24/7 making the place reek or burning giant holes in the carpet.

I am all for doing whatever you want to do within your own home, and I know that it sucks to be a smoker who wants to smoke inside who can't because of the rental agreement…because I lived that reality for most of my life as a smoker, even after I purchased my own home (because by then, I was used to doing it outside and didn't want to stink the inside up with it). But landlords are landlords because they need to make money, not friends unfortunately. I do think apartment complexes that don't allow smoking in outside spaces are idiotic, and would never live in one or agree to those lease terms ever. And banning vaping is pretty dumb, because it in no way damages the property.

That is why I said the OP should just ask. I can't imagine that they're including vaping in the sense that we mean it. It doesn't hurt the apartment. No point in suffering needlessly, or wondering and worrying, just get clarification and move on from there.


Things are different here in Portugal. No tenant would forbid you to smoke in your own home ("His" house, "his" property, but "your" home, since you are the one paying the rent to live there, and thus have the right to make yourself at "home", within the law).

And that happens because the tenant, not the landlord, can be forced to pay for those replacements himself. Many times, it does not happen, on a MUTUAL agreement between them, if the situation is not all that bad. Otherwise, the tenant is required to pay for those repairs himself before he leaves, because he is supposed to leave the house just as it was before. So, many smokers have the privilege to smoke in "their" home sweet homes, but knowing that someday they *might* have to spend some money to cover the costs of said privilege.

So, in my country, the very notion of a landlord forbidding tenants from smoking in "their own" homes, is already strange. Forbidding vaping?? Simply ridiculous. Just how would they inforce that? Where is the tell-tale smell? The darkening of the painting on the walls? The holes in the carpet? All those lasting, visible reasons that will keep non-smokers at bay?

Above all, where is the real EXCUSE for that, besides the sick need of sticking their noses in other people's PRIVATE lives ?? Do those tenants really find it so difficult to rent a house to non-smokers, after NON-smoking VAPERS have lived there ?? :(

Ah, the infamous "But I know it when I see it." Reading about that case makes my brain hurt and my soul weep for anyone with a functioning brain. Legislating morality always has been and will remain to be a pretty poor idea.

On another note, goodness, I could really destroy the cupcake in your avatar.

OP, I wouldn't get too down about this. Others have pretty well covered it, but the way it's worded, it simply does not apply to our vaping.

Here is the verbatim amendment to the rules and regulation for the apartment complex where I live: "Smoking of any substance (including the use of devices that stimulate the act of smoking if the device discharges smoke, such as certain electronic cigarettes) is prohibited throughout the project, including the apartments and lanais."

My question for you, dear forum members: Does a typical e-cigarette, like the ego-C which I am currently using, "discharge smoke"? It has always been my understanding that the vapor produced by most e-cigs is not the same as smoke. If this is correct, can anyone here point me to some form of evidence that I could leverage in the event that I am fined for vaping in my apartment once the new amendment goes into effect?

I wish I could say I was surprised by the OP's situation but, unfortunately, this is the current State of the Union. Apparently, it's unimportant what the facts are, it's only important what others perceive the facts to be. You appear to be smoking, therefore you are and are one of those evil smoking people.

Pfffffffffffffft....it only changes once people become willing to say "No".

I agree with others about the use of the word "certain". Your not smoking anything, you are vaping so Ido not see how this rule applies to you.
I assume that your lease states no smoking? Also I do not think that they can ammend the terms of your contract/lease half way through it.
They can only ammend it upon signing a new lease. Unless the law their has recently changed stating that people cana no longer smoke in public areas. Which again would not apply to you since you are not smoking.

Since they cannot ammend a contract without both parties agreeing to that ammendment I fail to see how they could evict you.

Print out some info from Cassa an have it on hand to explain vaping is not smoking if your questioned.
