I am not sure how many of you follow issues on copyright and fair use in Canada. It appear that the Harper government is trying to introduce yet another bill to pass some very draconian copyright legislation similar to the DMCA in the US. Put simply there trying to give us the screw at the behest of the Big American media companies. This is their 3rd kick at the cat in as many years to get this sort of bill passed. Its not offically been presented but its been in the works for awhile.

These types of laws have been implemented in various ways with varying degrees of success across the world. The implications for these types of laws can be far reaching and always detrimental to the honest consumer. the governments make claims that these laws are necessary to catch up with technology and to protect consumers and the public good. In reality these laws are being implemented at the behest of big business and indented to take away the rights you enjoy today.

If you think that this does not concern you then think again. The government counts on your ignorance on the subject to get these types of bills passed into law.
Do you record television programs to watch at a later date?
Do you make copies of music you own to play on various devices like a Computer, Ipod, CD Player or streaming media center?
Do you make copies of movies you own to back them up in the event the disc is damaged?
Have you ever lent a friend a book you have purchased to read?

I have seen previous bill of this nature in the past like bill C-61 and these are some of the rights you stand to lose. In the previous bill these are some of the items they tried to pass into law.
Copying any CD with a digital lock would become illegal. This means if you transfer a song from a legally purchased CD with a digital lock to your iPod, you could be subject to a $20,000 fine.
Breaking the digital locks found on almost every DVD out on the market would mean a fine of $20,000.
If broadcasters decide to put digital locks up to block your PVR, then you would be subject to a $20,000 fine for breaking into it.
It would be illegal to unlock your cell phone to avoid roaming charges or change cell phone providers. This would be subject to a $20, 000 fine.

Keep in mind this does not preclude a media company form coming and suing you for more money. And oh yes the lawsuits that the Americans have had to endure. I really don't think that its right that some hard working family can lose their house because they didn't realize little john was in the basement downloading music illegally. Do you know everything your children do on their computer? Maybe you should but that's another matter.

I am not going to be able to cover every aspect of how this could affect you the everyday hardworking Canadian, others can do that far better than myself. I suggest you do a search on the internet on words like "Bill C61" or "Canada DMCA" or head on down to Michael Geist's blog Speak Out On Copyright and get the facts

I was not trying to be ignorant, your explanation is what I believe it was about. What through me for a loop was the reference in the article wrt exemptions, that confused me, and completely understandable since your intro was sort of vague, well to me anyway.

The fortunate part about this law is it falls under the stupid and unenforceable category.

The government has no way nor the resources to stop everyone from copying CD for example. With the existing laws where currently it is illegal to copy for re-sale, they can't even enforce that, just go to your local flea market.. If you can't utilize the power you have, what good will more power do?

The law will pass, and trample our basic rights yet again (maybe it was a mistake to assume we had any rights to start with??) and some poor kid will get charged with his stash of rip'd CDs and that will be the end of it. The media industry will use that to threaten/scare everyone and recover their investment/bribe required to this into law.

The information age has fortunately been able to progress to the point of where government is unable to control it. This protects many of the rights we should have, by creating an anarchy to a certain degree. I find it very funny that to import a $10 pair of shoes you get hit will taxes, duty ect, where I could email/electronically transfer the complete designs for a nuclear reactor or some multimillion dollar contraption in or out of the country for free.
