To add some lift to this subject..

My daughter is a supervisor in a city office in Ontario.. (I do not want to make which public). She told me recently that the only 2 smokers in her office changed to vaping. They had asked her if they could vape at their desk.. and she allowed it.

She was confronted in the days after by 2 of the other workers who complained about the smoke and 1 was worried because of her asthma. My daughter response.. :Oh I know all about those e-cigs.. my father has given me the lesson about them from a to z and backwards.. It's vapour and harmless: . To the girl worried about her asthma she told her :It's probably a lot better for you than the recycled air your breathing in here:

As another note my daughter never smoked and her husband is a bio-chemist.

I did tell her after she told me about this, that I will probably always be excited about discovering e-cigs and the changes I have achieved.

Now I will have to find something else to talk about when she visits..:)

So after the union staff rep called and said he didn't want to talk about misrepresentation, and said there's nothing they can do about the policy and the fact that it is harassment and discrimination, I emailed him a summary of our conversation and asked him to confirm... Well it's been 2 days now, he replied yesterday and said he's give me a call by thismorning. I replied that I'd prefer email communication, no reply back yet. I've been burned before with conversations that "never happened", so I prefer to have an email record. Seems like they don't want to go on record, heaven forbid they be accountable for their actions...

On a side note, I've been brainstorming the past couple of days some good slogans and / or art work that could be applied or printed on t-shirts, jacket patches, hats, toques etc...

Something like "I vape because everyone's health is my concern", "I'm a vaper, you're welcome", "vaping saved my life, the government wants to take it" etc...

These are just some ideas, I'd like to see what you guys can come up with! The idea is to get people's attention in a positive way that will get them talking, thinking, and asking questions. The more people that are well informed the better!

Hey GoatScrote any updates on this matter, it's been a while?

This is unbelievable! This is a provocation? This is simply absurd and defies any sane interpretation of Bill 168 and ignores the findings of the MOL safe at work investigation. What other things will they fabricate? I was there at 11:45. No such thing occurred.

Who’s harassing who? This is abusive and I would like your ideas on how this can be stopped. Worse part is that these attacks are coming from the same people that we are supposed to go to to fight these harassments !!?!

Dan,

While entering the building through the back doors today at approximately 11:45am I had to walk past you under the back door enclosure while you were using your vaping device.

I observed you at the back door as I was walking from my parking spot and approaching the entrance; it was clear to me that you inhaled with your vaping device and held the vapour. You waited until I was directly in your path and exhaled the vapour.

I would have chalked this up to bad timing if there had not been multiple occurrences in the past that you did this.

This was a deliberate and threatening action which contravenes Bill 168 and I will not tolerate this ongoing harassment from you. Your actions violate my right to a safe workplace as well as the right of everyone who enters and exists the building.

I will protect myself from any further acts of aggression; I would ask that you conduct yourself accordingly and act in the best interest of everyone’s safety.

There has been a considerable amount of time and effort spent addressing the issue of vaping; a policy was put in place to ensure the safety of those in this building from exposure. It troubles me that you would go out of your way to find another way to put people at risk in a common area.

I will ask management to investigate this ongoing situation.

2. What proof that this incident actually occurred?
3. File a counter action for bullying in the work place. And don't wait do it now with extreme prejudice!!!!! :evil:

Agreed, but the complaint has to be filed through Dan's union health and safety rep who is the person who filed this complaint :mad:

Slohand you know that's a load of chit. This is not something that can be handled by the "Good Olde Union". It is a corrupt body just like every other human organized institution.

This requires action independent of the hand holding of the union which he pays to represent him. Get a human rights lawyer and SUE.

Right now i'm considering filing with the Ontario labor relations board, and conscientiously objecting to paying my dues to the union so I can divert those dues to a charitable organization as a charitable donation, maybe CASAA. I can't consciously continue to pay these people to keep harassing me, it hurts my mind... i'm starting to wonder whether a proper lawyer would be a better idea, any suggestions?

My first reaction was uncontrollable laughter, then a bit of anger, then laughter again, but a touch more maniacal. trying to use bill 168 to violate bill 168, Heavens to Betsy! Furthermore, I don't even know this guy, never spoke a word to him in my life!

The line where it says "I'll defend myself from any further aggression" (or something to that effect) also reeks of threat to me. If i'm outside vaping, which I only have to do because of their ridiculous policy, will this crazy bastage see it as "aggression" and shank me in the back, prison style? Holy Dina...

It sounds like he is just quite intimidated by you.

It sounds like it was a him or me thing and you didn't get fired so now it's going to escalate into something weird. I'm assuming he was one of the ones that walked off the job to "prove the point" just off the body of the email.

Did you bone his wife or something? Maybe he snuck a peek at the urinals and got intimidated? Perhaps he has a bit of a homo side and your manliness might convert him.

You didn't really vape, hold it in and blow it in his face, I assume.

All joking aside this is more harassment for you then it is for him. You have been singled out and forced into adjudication. Your name must be slandered and pasted all over some company and union emails. Yet you still have the same rights they do under the same Union act. So how is it fair that they can continue this, while you are just supposed to take it while a review has already been done. Ihope when this all gets settled you go after the union for a great deal over the .... you had to put up with so far and get rid of ..... corporate ... kissing dicks like him.

Sorry about the language, but in all my dealings with unions those little crybabies make the most noise and get what they want. Keep on fighting the good fight, and bring every piece of Cassa literature with you everywhere you go at work until this is settled.

I have read most but not every post in this thread, so forgive me if some of this has already been gone over.

This guy is obviously not giving up and will continue to do all he can to harass you. I assume there are no witnesses, so it's his word against yours. Of course if someone is willing to lie, they are probably also willing to ask others to lie for them. Hopefully if he didn't talk about having a witness so far, he will have a hard time producing one in the future.

'I will protect myself from any further acts of aggression' is in my uneducated opinion a threat and I would seriously consider asking management to take action to assure that he does not assault you for some imagined transgression. I don't think there would be any harm in talking to the police about this either. Doubt they would/could do anything, but it can't hurt to have it on record. Having said that, IMO the worst thing you can do right now is lose patience. Stay calm, look at all your options calmly, clearly and thoroughly.

Another thing that occurred to me is, is the back door enclosure where people are allowed to smoke and vape? If it is, is there a rule that smokers can not exhale in the direction of non-smokers? How close to the door are you allowed to be? You see where I'm going with this? One option I would consider is to remove myself physically further from the non-smokers/non-vapers to avoid conflict. It might seem like a loss, but if it is a viable option it might take the wind right out from under this idiot's sails until he figures out the next mode of attack. When possible, defusing a situation is almost always better than escalation. Up to a point.

I would also talk to a lawyer, mostly about the way your union has handled this from the beginning. Lawyers are expensive, but the first consult should be free and that will give you some idea of your independent legal options. If you can get a free session, you have nothing to lose.

I repeat, this really sucks! Hang in there guys!!

Hey GoatScrote!

Just a point that you may want to stress to anyone involved that if you "inhale the vapour and wait" for about 3 seconds the vapour will dissipate and nothing much, if anything, will be exhaled. It is known in the community as stealth vaping. Not sure how he could have experienced what he claims to have experienced. It should then become obvious who's doing the harassing.
