Let me make it clear: FDA regulations can be whatever they want. They can define "tobacco flavor" as they wish and then apply this meaning to e-liquid too. There's little chance that by just writing "tobacco" on the bottle you would automagically meet their definition and requirements.

Halo tobaccos are sold and advertised as tobacco flavors. That is what will count...

If it is so much less than smoking, wouldn't these people be getting nic sick from smoking? There was a recent thread where someone got nic sick from licking 1 drop...

No, you misread what I was saying. We DO add liquid nic, just like with any juice, so it does have an appreciable nic content but only because the nic is added to it when mixing it up. The point was that the nic had to be added else there would be little in the juice.

How much cocoa is in "Synthetic Chocolate"?

Since you seem to be challenged by the use of qualifiers, let's simplify:

"3. Chocolate

(a) designates the product obtained from cocoa products and sugars which, subject to (b), contains not less than 35 % total dry cocoa solids, including not less than 18 % cocoa butter and not less than 14 % of dry non-fat cocoa solids;"

I can totally see a regulation saying;

"3. Tobacco flavour

(a) designates the product obtained from tobacco which contains [....]"

Could you be a bit more polite please??

My understanding is others are Not supposed to use derogatory terms when addressing other posters.

I wonder - if we stop ingesting all these recreational products, and feed ourselves only with proven, beneficial drugs approved by FDA, would that keep the doctor away?

NO.

That would make us Go to the Doctor More. But that is Exactly what is Needed to keep the Health Care System going.

its an apple a day keeps the DENTIST away, its natures toothbrush :)
next they'll want to dumb down the look of the product as to not confse children they just look so tempting to eat. give'em an inch and they wont stop taking, fines or possible jail time for parents of children caught with ejuice and if its any flavor other than tobacco or menthal....does oregon have a death penalty? :p

Just don't tell that apple seeds are toxic, they contain cyanide compounds and can kill if you eat a large quantity. They might ban sales to under 18 or something.... :laugh:

With the good portion of the less harsh drug war coming to an end with the legalization in several states of recreational or medical "weed" as well as the numbers of smokers declining the states are losing out big time on revenues since prisons are for profit holes as well as less cig tax revenues coming in they need a new war!

One former leader of the former Soviet Union appears to have called it correctly when stating "we will take you without firing a shot!" as our individual liberties seem to be diminishing under a new updated form on US Communism! Corporatisms instead of Socialisms now on the menu!

Tomato plants do have an appreciable nicotine content. I'd be willing to pay extra for liquid nic sourced exclusively from tomato plants, if doing so caused the FDA scientific/legal difficulty in categorizing our industry as "tobacco products"........ :)

I don't see how this would be possible to enforce, there by pass it. TFA flavoring like you mentioned is used in e-cig liquid, whoever its also used in baking (ex was a cake decorator). So banning a flavoring used in e-cigs would ban ALL flavoring state wide, and your grocery stores baking/cooking isle would be completely empty.
