The FDA rules haven't been officially finalized and they 'have not gone far enough' per Senator Reed.
At the halfway mark they go over the proposal for further regulation; including eliminating online sales and "candy" flavors.

Even stating at the end that all he is/they are waiting on is finalized regulation before they begin to try to clamp down harder. This is a good first look into future proposed regulations after the FDA regulations are announced.
