Safe Cig SCAM??

i will try to make this brief lol!

my first e-cig was a safe cig. they doubled my first 2 orders. then they emailed me saying i have to send the extra stuff back or they will charge me again.

i called my bank the next morning and canceled my debit card. ironically, i got their email wanting their stuff back the first night i had my vapor4life stuff. obviously i have no problem sending their overpriced crappy products back.

so i replied to their email and said fine, i am ready for the shipping label. they sent the shipping label on MLKjr day, which is a FEDERAL HOLIDAY...um, i was no where near work or a printer that day. when i got back to work tuesday night, i tried to print out the label, it said it was expired.

so i have been exchanging emails with them...they say their label thing is messed up and they cant send me one right now...i called them liars...they swear up and down they arent lying...

i am a student w a full time job. i do NOT have time for this!

i will be sending them their stuff back hopefully monday afternoon, at my own expense, if i can get an address. i will have to dig out order numbers to go with it? should i get delivery confirmation?

i canceled the card, so the bank assures me that they cant charge me again, but they could try to slap this on my credit.

wanted to share this so people know to BEWARE!!

see, i can just call vapor4life on the phone...is so nice...sigh...

*oh, and the debit card canceling was a pain in my rear end. it also made me look bad as i was purchasing some stuff from the classifieds on here.

I wouldn't even pay to ship it back I would save every email communication and wait for them to email you another label to print out of ask them to send you one, and get some type of confirmation # and the persons name you spoke with, tel them as soon as they get you the label you will send there stuff, most I would spend is the .80 or whatever it is for a confirmation or signature confermation that's it just so you know they got it and can prove it. Why should you pay for a mistake they made, do they not have some kind of guarantee or time to ship it back to them if not happy with the product.? I wouldn't sweat it one bit especially if there one of these scam companies over charging for a crappy product

I thought it was a law that if a company sent you items you did not order, or pay for, then you had no obligation to pay for their mistake.

That may have changed, but it seems reasonable. Otherwise scammers could start sending out stuff to random people and demanding payment.

I have heard about this as well, but a quick google search couldn't find anything. Anyone able to shed some light on this law?

According to the Federal Trade commission site's FAQ: Unordered Merchandise <-- www.ftc.gov

A. No. If you receive merchandise that you didn’t order, you have a legal right to keep it as a free gift.

Q. Must I notify the seller if I keep unordered merchandise without paying for it?
A. You have no legal obligation to notify the seller. However, it is a good idea to write a letter to the company stating that you didn’t order the item and, therefore, you have a legal right to keep it for free. This may discourage the seller from sending you bills or dunning notices, or it may help clear up an honest error. Send your letter by certified mail. Keep the return receipt and a copy of the letter for your records. You may need it later.

Q. What should I do if the unordered merchandise I received was the result of an honest shipping error?
A. Write the seller and offer to return the merchandise, provided the seller pays for postage and handling. Give the seller a specific and reasonable amount of time (say 30 days) to pick up the merchandise or arrange to have it returned at no expense to you. Tell the seller that you reserve the right to keep the merchandise or dispose of it after the specified time has passed.

I would consider reading the entire page, or contact the FTC if using this as your defense. Wouldn't hurt to have them aware and on your side. Good Luck, and keep us posted :)

yea that seems pretty screwey that they'd charge for stuff you didn't order. once is a mistake, twice is a scam. usually places don't know that they sent you items by mistake, it's just an oversight.

i'd seriously look into the ftc thing. tell them you're under no obligation to return anything and make them aware that you will dispute any further charges on your card.

Most states treat unordered merchandise as a gift. Persons sending unordered merchandise through the mail are prohibited from demanding payment, and you have the right to keep the goods or to dispose of the goods in any manner you wish. Moreover, billing for unordered merchandise may constitute mail fraud and/or misrepresentation.





i think your extras would definitely fall under "unordered merchandise". i'd seriously jot the ftc an email.

I know this is an old thread...I had receive a double shipment from them I believe early 2011 (before I knew better) and they tried to tell me that same load of.....I wasn't charged and never sent it back. Ironically, it was because I lost their batteries that I found the true vaping world!


p.s. Let this be a lesson to all those would be buyers: Today is April 4, 2012 and I just received an email response from them regarding a ticket I submitted on December 29, 2010 02:11 pm (PST). How about that for customer service.8-o

Sometimes mistakes happen, here is what happened to me lastyear with a different vendor

Boxelder was having one of the 50% off sales so I decided to order a couple of things.

Here was my Order:
1 - Gallon of VG
1 - Gallon of PG
1 - 250 ml 100 mg nic

Here is what I got from UPS:
12 - Gallons of VG
12 - Gallons of PG
20 - 500ml 100 mg nic

My front room was full of boxes that were leaking PG and VG all over the place. I contacted them about the order, it took a couple of days but I think once they opened my email they were all over it. I had to re box it up, Fedex or UPS would never accept boxes that are leaking fluids. Sent it back and they sent me a free bottle of 500ml 100mg nic.

Worst part the nic was terrible and this was during the time where the reports of dangerously high nic was sent out.

I never used any of it. Just a huge waste of time. I should have started an e-liquid business. haha

What occurred was an "honest shipping error". The law doesn't apply to the original issue--that you can just keep it worry-free.

Whether or not it was actually "honest" is another matter entirely.
