I know you said that this case is straight forward and that's good, I understand that.

But is there anyway that we can also prevent them from trying something else at the same time?

My fear is that even though HC can be stopped this time what is stopping them from taking a different tactic and banning it for some other stupid reason.

Or will this stop them cold and vendors can operate free of future reprisals and we can vape ourselves silly with no worries.

In a class action, how does the language of the lawsuit get written, and by whom?

To answer your question gadelson, the language of the suit will be written by our legal counsel. It would have to be, lol: that's part & parcel of the job, and I don't know anyone else who would even know how to do that.

Following the posts here and the way you are handling questions Rachel gives me even more hope. Your replies show you as very patient and very good with language skills and all your information is really good from #50 onwards. You are exactly the best interface for the vaping community with these qualities!
I've had to deal with family law in the trenches for 8 or 10 years and am unfortunately very familiar with legal ways, the need for patience and the right wording.

Hey everyone! Just wanted to let you know that we got an email today from the lawyers, asking if we'd be free to meet with them this week. Yay!!!

We are also absolutely thrilled with the fact that today, the FDA admitted final defeat on this issue down in the States. Just makes our case here that much stronger! We'll set up the meeting & hope to have good news for you soon!

A class action lawsuit was not the tool to use.

It was a very good idea, Rachel did a lot of work and had a law firm involved and vendors behind the idea. However with a class action lawsuit large damages that can be proven are the basis of it, and provide the funding for it, and that assume the law is 100% on our side to start.

The law is not clear making it all the harder to progress in the manner, so the idea was abandoned.

This idea had moved to become the ECTA, were the approach has become following the ECITA’s lead in the UK of industry self regulation and working with the government.
