Hey, all...I stumbled across this article and one snippet really caught my eye...

How Safe Are E-Cigarettes? - ABC News

On page three of the article it says this:
"New York's move is a reaction to what can't yet happen on the national level. According to a series of recent court decisions, e-cigarettes cannot qualify as drug delivery products, said Jeff Ventura, a spokesman for the FDA. As a result, the agency cannot ban them or require more arduous testing."

Does this mean the FDA is quietly conceding?

That would be wonderful, but personally I doubt it as they don't like to back down under any conditions. But, one can hope. Noticed in your banner or whatever that thing is called - a reference to Moxie! Are you talking about the soft drink? When I was a kid growing up in Maine that was my favorite! If there is a e-liquid with that flavor it whould probably become my favorite on first vape. There is no Moxie here in Ca. to my sorrow.

The FDA will never quit. The reason is they are funded by the pharmaceutical industry, and the pain of falling NRT sales as electronic cigarettes gain ground will be intense. If you had an industry worth hundreds of millions of dollars, and some guy came along with something that would make it redundant, would you quit? Of course not.

The FDA has a reputation for ignoring court verdicts for as long as they possibly can, so they'll drag this phase out.

After they have to give up on that, they will start in on regulating e-cigarettes as a tobacco product. Expect a great many court battles over that as well, as there some obvious moves they will try: stopping mail deliveries, reducing the nic content to useless levels, banning flavors, and so on. It looks as if they may have the power to do some of these things.

This will run and run. :(

I know this is very controversial to many, but we really need to get the Tobacco Companies on our side. After all, without them, we don't have the nicotine liquid that is used in making e-liquid for our PV's. They have the money that is needed for the studies that we all know must be done to prove that the vapor is magnitudes safer than inhaling smoke and that there is no harm done to those around us from exhaled vapor.

You are most likely right, MR. They are likely to start investment now that the legal framework has been defined. They won't cooperate with the electronic cigarette industry at this stage, it's not a good commercial move. Instead, they will start on things like business plan research - costing the manufacturing, marketing and distribution, and researching the likely future of the market. When and if that looks promising, they will go to market. At that stage they will implement other measures such as clinical research and so on.

However, they are bound to see the established e-cigarette industry as a competitor, and will do what they can to beat or if possible eliminate competition - it's simply good commercial sense. Look how hard the pharma industry is fighting, don't think the tobacco barons are an easier touch. For example they will try to buy patents, or buy exclusive regional distributorships from the manufacturers.

So, yes, as they move into the market they will improve some aspects for the existing trade. And they'll also fight hard against it. That's business.
