FDA Sen Johnson (R-Wis) demands answers from FDA RE deeming

I read the latest regarding Sen. Johnson's second request for info. Given the FDA's obvious resistance, and the fact that the government doesn't move at a fast pace, does anyone think the issue might have any type of resolution before Aug. 8th?
Resolution probably not, more cause for an injunction yes.

Unfortunately, no. The States are pretty much allowed to do their own thing as long as it doesn't conflict with Federal Law (well, usually, but we won't get into that here).

Even if the Feds are forced to go back to the drawing board as far as e-cigarette regulation, States can still go ahead with their own agenda.

It would be interesting to see how things shake out at the State levels if there is an injunction. Some States can be pretty dumb while others pretty smart. Indiana and WV are good examples of dumb and smart.

My State is pretty dumb so I would have no expectations of anything sensible. But I border WV and it's pretty clear they will be vape friendly until the Feds layer on a bunch of crap.

When Maryland raised their cig tax a while back, tax revenue increases "unexpectedly" didn't correspond. Bordering VA with much lower taxes made it an easy decision to make a drive every couple months. I probably saved a thousand bucks making that short drive. Lol

States can take advantage of opportunities. Delaware has no sales tax and people drive there all the time for large shopping trips . It's a boom to their economy.

If left solely to the States there will surely be plenty of dumb and smart spread across the country. People living in the dumb states just need to hope they live close enough to a smart one.

If there is an injunction, I would imagine some states will pull out all the stops in order to rush their own agenda through the state legislative process. Even if the FDA is finally forced to use common sense in releasing a deeming regulation (yeah, yeah, yeah, I know, but I can dream can't I?), there will be some states that will use the original deeming as a guideline to effectively ban e-cigarettes, whether it be through outrageous taxation or outright banning of local sales.

Totally agree, retired1. My State loves licensing and tax revenue. Individual Counties like to add little extras too. They would be vape friendly in the sense that as long as you pay to play then you're OK.

My County actually controls all liquor sales with county run liquor stores. Beer and wines have to purchase everything from the county warehouse so prices are expensive and fixed. I just drive to DC and not worry about it. My father did the same thing every couple months. I would ride shotgun with him every trip. It was quality father son time to boot. Lol

For me, it's more along the lines of what the state is going to do than the FDA, that has me stockpiling stuff. It's the thought of how they're going to try and tax the crap out of stuff to make up that "lost revenue" that has me concerned...

They technically have 15 more Hours until the 21+ CA Law goes into effect on buying Tobacco Product Meteors (TPM's).

I've heard that some are trying to Skirt the CA Law by having Affidavits stating that None of the Meteors that are sold have hit a Vaper. So they Can Not be Classified as a Tobacco Product. But I'm not sure how well this will hold up.

You would think that Governor Moonbeam would Not have signed a Bill that included TPM's? But if one lives in California, very Little is Surprising as to what can become Law.

I dunno. After all, even if it didn't hit anyone... if a meteorite could reasonably be expected to hit a vaper.... ("reasonably" in the unreasonable view of the regulator, of course.)

It is Fine. And a Great Way to market a VW Flashlight.

But the Problem is as soon as you Point it at a Meteor, then it becomes a Tobacco Product.
