Seriously, can we mount a class action suit against ASH if imports and sales are banned?

My wife is not a lawyer, although she did pass the bar. She says that you have to show that some harm has been done to you in order to file a lawsuit. Like after you get cancer. And then you still have to prove you would not have gotten cancer if you could have used an electronic cigarette.

But then I look at the suit filed by ASHole seeking punitive damages (the link doesn't work anymore so forgive me if I got that wrong) for claims made by Smoking Everywhere that he says are false because there is no proof they are true.

But ASHole is making all sorts of claims that are false, and if successful and can be shown to have contributed to a situation where thousands upon thousands of people who have quit smoking tobacco are then forced to go back to tobacco for lack of a safer and healtheir alternative...

Well, why can't he be sued?
What would it take to be able to sue this guy?

He sues people for telling the truth because it can't be proven that it is the truth.
And then he lies all over the place to try and prevent our access to these devices.

Seriously, I know I can't be the only one who wishes they understood.

Unfortunately this wouldn't work. There are safer alternatives to smoking for the intake of nicotine, so you wouldn't be forced back to smoking. Not to mention you would need someone with REALLY DEEP pockets to fight those that shall not be named. You could bet that BT and BP would fork over all the money he would need for a defense.

I have lived a fair long time, and studied history, and frankly the only time I have seen laws passed that benefited the people, has been when there was a grass roots ground swell that reached critical mass (in our case too many vapors to be ignored) coupled with some degree of "civil disobedience", and publicity publicity publicity.

Even if we had cause for a law suit, they can be too easily buried to be effective.
