"awarded to users of this new product which the Food and Drug Administration [FDA] has declared "illegal,""

Since when is illegal given as "illegal"? Does that mean legal but sort of not? Does it mean "illegal" with two fingers on each hand up as in "laaaassssser" ala Dr. Evil? Ecigs are certainly NOT illegal. And the FDA cannot themselves declare something illegal, although maybe they can declare something "illegal". Does this mean "cops" are going to come and take our PVs away? Or does it really mean that banzashole is not a lawyer, but rather a "lawyer"? He is trying to "protect" the common man from "dangers" that are not well "understood", and we need to be "re-educated". Maybe in a PV offender's "camp". With strong and convincing "therapeutics" and "compelling" information.

Agreed bullets are too good for him. Slow death by spoon.

Hey Banzhole, if you or any of your minions are reading this, I will repeat what I have said before on numerous occasions. You better back off and shut up, because we have the truth on our side, and you are biting off WAY more than you can chew messing with us.

Your career may just be over with the mistakes you are now making.
Chew on that for awhile.

Freaking asspocket.

I urge e-cigarette users to send John Banzhaf an e-mail urging him to stop protecting cigarettes (by advocating a ban on e-cigarettes, and by advocating litigation against e-cigarette companies), and telling him about your experience using e-cigarettes (e.g. helping you quit smoking or cut down cigarette consumption).

His e-mail address is jbanzhaf@ash.org

I think many here would be willing to do that; however, I cannot imagine that particular man actually reading them. Perhaps if someone threatened to withdraw funding, he might take notice, but money appears to be his only motivation. What's in it for him?

Here's the e-mail I just sent:

Professor Banzhaf,

I am confused about your stance on smoking & health and I am hoping you can clarify a few things for me. The Action on Smoking & Health website states that you are considered "Mr. Anti-Smoking" so I do not understand why your stance is in direct opposition to that of ASH UK in regards to harm reduction and its inconsistency with your stated support of nicotine replacement products sold by the major pharmaceutical companies like GlaxoSmithKline.

Your latest announcement, that you have drafted a template for class action against Smoking Everywhere, is particularly troubling. I have read the brief and it appears that the crux of your argument is that Smoking Everywhere advertised that their products do not contain ingredients in tobacco smoke that are known to cause cancer but a recent FDA study detected trace levels of tobacco related nitrosamines. Assuming that this action is successful, do you intend for this template to be used against other companies who advertise products "without the harmful carcinogens that cigarettes contain" that have been shown to also contain nitrosamines of the same type and concentrations found in Smoking Everywhere's cartridges?

I am a dissatisfied customer of Smoking Everywhere as I have found their products to be overpriced and their customer service is abysmal. However, the company is responsible for making me aware of the existence of smoke-free alternatives and for that I am grateful. Approximately a year after spending hundreds of dollars at a Smoking Everywhere mall kiosk only to misplace it, I have now purchased a more affordable electronic cigarette and I stopped smoking completely almost immediately. In the past, I've tried the Nicoderm patch, Nicorette gum, Commit Lozenges, Hypnotherapy, and plain old "cold turkey" each with limited success but ultimately resuming the deadly smoking habit so I was not expecting to quit smoking when I purchased an e-cigarette. Since replacing my 10 year, pack-a-day habit with a personal vaporizer, however, my sense of taste and smell have returned and cigarettes are now repulsive to me. I am continuing to use nicotine right now even though most of the withdrawal symptoms have subsided because it seems to help me cope with the symptoms of ADHD. I appreciate that I can use my e-cigarette to wean myself of nicotine if and when I choose while continuing to enjoy relatively harmless vapor whenever the urge to smoke rears its ugly head. In the meantime, I have eliminated all tars, I don't stink of stale smoke, I have my sense of taste and smell back, I am regaining my lung capacity, my blood pressure is returning to normal, and most importantly I am no longer exposing myself or my family to the dangers of smoking.

If you are truly concerned about smoking & health, I do not understand why you would not encourage current smokers to consider reducing the harm they do to themselves and their loved ones through the use of smoke-free products like those marketed as "electronic cigarettes". If the concern is false advertising claims, I wonder why you have not voiced the same concerns about more blatantly false claims made by major pharmaceutical companies?

I eagerly anticipate your reasoned response.

Best regards,
Thad Marney

Okay, I am no particular fan of Dickie Scruggs. But, in his defense, I just have to point out that he was going after Big Insurance when the indictment came down.

In the wake of hurricane Katrina, Big insurance husseled its little limo right up capital hill to ask for tax-payer bailouts. At the same time, it was refusing to handle claims for wind/water damage throughout the southern half of Mississippi.

Shortly after Mr. Scruggs and company filed class action suits on behalf of the newly homeless, the entire town of Oxford, Mississippi was shut down all afternoon while the feds cleaned his office.

BTW, the premium on my house--in northern Mississippi--has been doubled!
