Lost, there should be a grievance process of some kind where you can dispute the finding by the agent. Since when do agents decide this stuff? Laws vary by state, so IDK. Agents mostly just sell insurance, etc. The claims people handle claims. Or so I thought. I don't know much about it though. I'll ask around.

@Lost. I'm pretty sure it depends on the policy and the state laws.

If your DD has a policy that's only PL and PD, it doesn't cover the car per se, it covers all the other liability...so they don't pay for the car damage.
If it's more coverage than that......read on!

The agent doesn't decide the claim. However, when people get into an accident they call their agent. The agent is probably repeating what the claims people said, or he/she looked up the policy, saw it didn't cover anything and said so.

If it does cover stuff (CHECK THE POLICY), and the police report said she's not at fault, you can do some things:

1) She should call the claims department directly and speak to them directly.
2) If that doesn't work, and you think you are being screwed, you can ask about a dispute process. Tell them if you are not happy, you will call the state insurance commissioner
3) If you're still not happy, call the state insurance commissioner...AFTER you get all your facts straight. People do that all the time. Puts the fear of God into the insurance companies.

She really doesn't have much to lose rate wise if she's in a high-risk pool already anyway. So fight away if you think it should pay out.
