So the FDA ban proposal is just for the selling of them correct?

in other words, the e-cigarette will not become contraband through legislature, it just can't be sold here in the USA.

I'm just curious, because this means that we could still buy from international suppliers, which does mean more shipping, but there would still be suppliers available for us.

I guess i'm just curious because i've seen quite a few people posting about stocking up like mad, but i don't think that it's totally necessary.

Most likely the ban would be similar to other NRT bans like nicotine water (NicLite). When they "ban" NicLite, the ban did NOT cover customers purchasing nicotine and bottled water separately and mix them for themselves. It did not even ban chemical supplier company from selling nicotine suspended in pharmaceutical grade water in low concentration (that's what NicLite is in essense).

All they banned was: vendors selling nicotine suspended in water AND at the same time, claiming that product as nicotine replacement therapy (or smoking cessation product).

The proposed ban would involve sale and import. If you have a mall kiosk selling e-cigs, close it. Your business would be illegal. If you as a customer or supplier order from China, your order can/should/will be stopped at the border and returned to sender, since it contains illegal items. If you sell online to U.S. customers, future sales would make you a criminal. No sales. No importing.

No one in the U.S. has proposed making e-cigs illegal to own or use, however.

But shutting the supply spigot is the first step to making them disappear -- at least for awhile. Surely, surely, e-devices have enough going for them that some savvy maker will get approval of some kind for a nic delivery device.

Take baby steps: Make no claims. Don't call it a cigarette. Package safely. Label properly. Instruct users. Follow applicable laws for all hazardous substances.

Surely a way can be found.

Well, i think the main reason they would ban it is because there currently isn't any way to tax it like alcohol and tobacco. maybe the FDA can work something out..but it's not looking too good so far.

The e-cigs were banned in australia because they could not figure out how to tax them, they were banned in mexico and somewhere in europe (i dont remember where).

The FDA stated that sales & marketing of e-cigarettes are illegal. Customs is stopping some imports. The FDA hasn't made any raids yet, but I don't think they normally do that until they've sent a couple letters.

As far as I know, the FDA can only control sales... they can't ban it any more than they already have. To ban people from buying them or using them is beyond what the FDA can do. That would require the DEA making it a controlled substance, and I don't see that happening, at least not without a few court battles.

The way I see it, the FDA ban is already in effect, it's just that the FDA hasn't started enforcing it very heavily yet. Because the FDA has already declared them illegal, any e-cigarettes you currently buy are technically black market.

e-cigarettes are banned not for any health issues, are banned for their design, anything resembling a tobacco product is banned to sell, produce or import here, seems like in the mind of legislators anything resembling a tobacco product will encourage people to smoke EXCEPT real tobacco products... candy cigarettes and chocolate cigars are banned too for the same reason.

So, in the future you WILL see this kind of arguments on your own countries, maybe not from the goverment but from anti-smokers, naming this devices "e-cigarettes" and designing them as a real cigarette, pipe or cigar IMO was a very bad idea from the begining.

Even if you set aside the fact that thousands of e-cigs are already in our evil hands, the Powers That Be are making a decision that is likely to backfire on their intent. All we hear is that we must save the children. Well these guys were all once teenagers, and most of them have kids. So how can they not know that nothing is more enticing at that age than Forbidden Fruit.

Rose, there are whole bunch of dumb A** in this country without common sense and they believe everything the goverment tells them. When the Pols say "it is for the children" and "for the American people" you should know we are are getting a hosing.
