The alternative had been that everyone could have argued with each other for a several days about whether someone had been shady..... made up their own minds ....got bored with it......and that would have been the end of the story.

bizzyb0t: I already mentioned that the case was in the EU (Could not remember which country at the time of my orginal post). I also began my post by stating that I stand to be corrected but thought that SJ is UK based and that therefore US law would not be applicable. Of course the cases are different and I do not really wish to get into a deep discussion about the general legalities that may or may not be argued by lawyers in any future cases.
I can only tell you that, since the case I linked to, here in the UK it is generally considered a 'grey area' at best, and forum owners are advised to err on the side of caution as a result, and certainly to try to 'nip things in the bud' so to speak. (BTW, I am a lawyer, but this is not my area of expertise)
I do not wish to enter into an argument on this subject and I promise I won't come back on the subject again no matter what. I did not intend to cause any controversy, but I was actually rather taken back at the vehemency of your reply.

It's not really the same. All systems of free speech involve rules to enable that free speech. So we can say that free speech is free within limits. The power of the genie comes from the bottle. It is the "containment" of free speech within rules that enables it to occur.

Free speech to me means I can turn to my wife and say anything i like , but rules dictate she would no doubt respond with a swift kick to the nether regions.

Could not have said it better Tauk ... I have been sidelined on the couch for the last few weeks , as some of you know, with my blown out knee. I watched this whole train wreck occurring in front of me and although I so wanted to be the voice of reason , simply knew the once the pack mentality that the anonymity the interwebs fosters started , nothing will stop it.
Lately this forum has been dividing into " he said/ she said " splinters on a lot of issues, with people jumping on bandwagons for whatever reason that don't really concern them directly, there are an awful lot of assumptions made based on the limited information they are fed by whoever is doing the feeding. I am a great believer in taking an issue to the source personally , if it is resolved , then good, if not then maybe ( just maybe ) I would make my feelings public, but it would stop there, I would say my piece, be satisfied it is heard and a warning has been given to others.
Nothing good can be gained by fervent attacks on a forum , it will only serve to rally the masses to one side or the other.
Free speech is a marvellous thing , but what people seem to forget when applying it, is plain simple human decency. Free Speech only works when tempered with this . Calling someone on their failings is fine, but honestly , do you think a personal or group attack on someone is likely to provide the answers you seek so desperatly?
A forum is a collective of individual minds, and can be an amazing melding of the qualities we all look for in one another. Sadly it can also be a collective of failings if we forget we are dealing with actual people rather than blocks of text on a screen that bother us for whatever reason.
It seems all too often in the anonimyty that the web provides us , it is becoming more of a "prove yourself" place than an "experience others" location.
I take no sides, SJ, Kate, or Parked are all welcome for a drink at my place......Tauk even more so for his writings above..... the pack mentality and stubborn disregard for human decency displayed in this whole sorry affair isnt..........
Trumpy - that's just about it in a nutshell. If we treat each other with respect then all is well. Our ability to respect each others' differences is mankind's redeeming feature. We need to use this ability more often.

I can't say too much about freedom of speech because I contradict myself on that subject, I believe we should be free to say whatever we want....but at the same time I then wonder why the hell we allow people to stand on our streets preaching their hatred for the western world.
Free speech is like traffic. Without traffic lights and stop signs, well, a lot of casualties would result. If a driver repeatedly ignores traffic signals, eventually there will be an "accident".
Anyway, there's a difference between calling someone out, giving your opinion on one hand, and basically trying to defame/destroy another member of a board.
What Kate effectively did was try to have Parked ostracized and removed from ECF. He had a LOT more to lose than she did. In the end she faced off with the admin, in a "go ahead, make my day" kind of way. She asked for it.
Maybe she was ready to move on anyway. Kinda seems like it.
