The Regulatory Challenge of Electronic Cigarettes (JAMA)
JAMA Network | JAMA | The Regulatory Challenge of Electronic Cigarettes

Two otherwise objective and knowledgeable researchers fall into the trap of endorsing FDA regulation of e-cigarettes without acknowledging that the "deeming" regulation (that FDA has stated its intent to propose and approve) would ban all e-cigarettes.

The authors also fail to acknowledge that the FSPTCA requires the Secretary of DHHS to determine that all new tobacco regulations would benefit public health (before approving any new tobacco regulation), that DHHS has not provided any evidence that regulating e-cigarette would (or even might) benefit public health, or that dozens of vapers and THR advocates have testified at FDA hearings/meetings and that more than 5,000 vapers submitted comments to FDA's docket stating that the "deeming" regulation would threaten consumer and public health.

Seems like most researchers ignore all the important legal and public health issues when advocating new regulations.

Here is the conflict of interest disclosure at the end of the article..

Conflict of Interest Disclosures: Both authors have completed and submitted the ICMJE Form for Disclosure of Potential Conflicts of Interest. Dr Benowitz reported being a former member of the FDA Tobacco Products Scientific Advisory Committee; serving on a Pfizer smoking cessation medication advisory board; and having been an occasional consultant to GlaxoSmithKline and McNeil, pharmaceutical companies that market smoking cessation medications. Dr Goniewicz has received a research grant from Pfizer.

Additional Contributions: We thank Rachel Grana, PhD (University of California, San Francisco), and Z Morgan Benowitz-Fredericks, PhD (Bucknell University), for constructive comments and Scott Rostler for editorial assistance. None of the individuals were compensated for their contributions.

He must have recently resigned from the FDA's TPSAC (as I don't think his term had expired).

Sure enough, he's no longer on the TPSAC roster.

Applying for Membership on FDA Advisory Committees
As part of the food and Drug Administration's (FDA's) ongoing efforts to recruit qualified experts with minimal conflicts of interest who are interested in serving on FDA advisory committees, FDA is requesting nominations for members to serve on its advisory committees. (More info)
