There is no law against buying fake purses, so why does ECF not allow clones?

Considering the fact that I can go to the mall, flea market, T.J. Maxx or Ross to buy a fake handbag... Why does ECF not allow clones in classified or co-op? I tried to start a interest for the new steel punk slug mod clone and it was closed. I received a pm saying that I should be careful with my clones and if I get caught with one, it is a felony. I call B.S. on that. I tried googling it and cant find anything stating that it is illegal to own a knockoff. Only that it may be illegal to manufacture such a thing. As consumers, that doesn't affect us and isn't our business.
If a company wants to seek legal action against someone replicating their product, that is their business. It should not be the business of ECF to restrict awesome opportunities of obtaining high quality clones at cheap bulk discounts because of their personal views. It is almost the same principle as us being angry at the ANTZ for trying to restrict our access to e-cigs simply because of their personal vendetta against nicotine.

There is a federal law about selling 1:1 knockoffs, especially when copying a brand name or logo. So if you buy one, you are essentially buying and in possession of illegal goods. These big brands typically have all the copyright and trademark papers and attorneys behind them. But trust me it is illegal, I know plenty of people that have had the feds knocking on their door for importing knockoffs, from purses, to dvds, sunglasses etc.

Yeah my friends mother was actually arrested for selling fake handbags and she's still dealing with the courts for it. So it is illegal I think some big companies have ways to get around the law. Like money...

I do know that fake Rolex's, fake LV etc are actively pursued. For that matter the jewelry industry seriously frowns upon me even changing a battery in a fake Rolex.

I am quite surprised how openly fakes are sold in the e-cig market, both by dealers and online.

Those companies are selling look a likes, Not 1:1 clones. Thats their loophole.

I always wondered how some of the Hana clones were able to get away with the ripped off logo on the outside, but what do I know. If their is no patent pending, or registered logo, it is wide open to be copied. Rolex are worth a heck of a lot more than a $30 vape tank. Vape gear comes and goes so who is going to patent it and have to wait two years to put it on the market under a patent. Buy then we will be on to super duper water vaporizers or something. They would miss the boat and go broke.

Well, the official rule of ECF is no 1:1 clones, which is silly. The slug mod clone doesn't have any logo so it should be allowed. So far people have mentioned manufacturers and suppliers have had legal issues.. We as consumers don't.. Therefore, we should not have a ban on the exchange of clones on here.

You as a consumer seem to be experiencing an issue with your affection for clones.

While that issue is not yet one of the legal type, you can thank the silly rule here on ECF for preventing you from running into such a problem.

How you feel about the rule is secondary to how the administration feels about becoming a marketplace for the theft of others hard work and innovation.

Have you heard of Patek Philippe? The most expensive watches in the world. In order to get into one of their stores, you need to "apply", which involves a background check as well. Also if you are Asian, you'll have a hard time getting in (reason being is because 99.99999% of all knock offs are coming out of Asia).

Its illegal to sell a knock off. What does that mean exactly? A replica of a product including identifying markings, logos etc that distinguish the product from others. Example, Coach hand bags are known for their lining and a plaque type of stamp inside the bag. If any of those are copied its illegal to purchase or sell. Now if the design of the bag was copied (is: what it looks like) without copying any of the registered trademarks, logos etc then its perfectly legal.

99% of fashion is a copy of something else. Believe it or not some designers actually copy lower end products because they are popular.

Canada Goose is a prime example. Everyone is making a parka in the same style as a Goose, but because they do not copy the identifying markings they are not knock offs, (PS don't buy Goose anymore as an American clothing company purchased 75% of the company and they will no longer have a life time warranty on the down).

There's no theft if they haven't taken the necessary legal steps to protect that work and/or innovation. Nor is it my or any other consumers obligation to protect it for them.

That said, the people who run the forum can allow or disallow any topic they see fit, same as the OP could in any forum he owns.

This thread title seriously had a me cracking up! :laugh: I find it interesting that while I have no problem with clone ecig products, you COULD NOT pay me money to wear bootleg/knock off fashion, bags, sunglasses, etc. Not due to any moral reasons, I just have really good fashion sense. :D

I realize that is very contradictory, but I have to draw the line somewhere. :laugh:

Totally not true, theft can occur without substantial legal proof (no patent) and thus no legal action is bound to succeed. However the theft still happened.

Similarly if I don't record the serial numbers on the cash I keep at home and I see someone take my money and walk away, a theft has occurred, I may not be able to recover my stolen money but it remains stolen property.

I don't know where you get your concepts of law from because it is just as illegal buy and posses counterfeit products as it is to sell them. As an owner of a counterfeit anything it can be confiscated. Are you allowed to hold onto fake money if it's discovered you are in possession of it? Fake Gucci bags - and if you want to push the issue - fake PV's are treated the same and can be treated the same. ECF is not going to enable either the purchase of or the subsequent sale and distribution of counterfeit goods. There are - you know - actually consequences for doing that.

When it comes to unregulated consumer goods all of this may pend on whether a trademark, patent or copyright holder pushes legal buttons. You sound like you want to do it, because you think it's ok as long as you don't get caught. Sorry - that doesn't fly here.

Its a hypocritical rule. I expect the leading forum for e-cigs to hold themselves to the same standards in which this industry is wanting ANTZ to hold themselves to..

We don't want the FDA to restrict e-cigs because of some personal vendetta against nicotine.
I don't want ECF to restrict clones because of some personal vendetta against "the theft of other's hard work and innovation"

The consumer purchase of a clone is not illegal and therefore should not be restricted by this site. Its not that I have an affection for clones... I have an affection for a well made product at a reasonable price. The greed of American companies seem to think the correct philosophy to a successful business is to control demand by limiting supply and jacking the prices. That in itself, is unethical. I wont give my business to companies who fail to understand that consumers should dictate the market, and to find an equilibrium point. This is why foreign competition is winning.

Because of the personal views of admin, this forum, consisting of hundreds of thousands of members are missing out on the opportunity to participate in cooperative operations in which we could get some of the most well made functioning products at unbelievable bulk discounted rates.

Anyone know of a good forum that does co-ops for clones?

It is not illegal for your mother to walk down the sidewalk with a knockoff prada bag. No one has or ever will be arrested for owning a knockoff. The manufacturing and distributing of knockoffs is a entirely different matter and doesn't affect me.

Funny you go and try to pin it to the "American companies". For the track record, my collection contains 3 mods that originated in the Philippines, and one from Korea. That leaves only two made in the USA.

Oops, I thought I was posting in the thread about authentic makers going after clones and reading the gaggle about Greedy America... :facepalm: :laugh:
