I've been informed (by an attorney representing a large e-cigarette company) that the FDA still hasn't even sent the "deeming" regulation (or the additional regulations that FDA plans to impose on e-cigs) to the Office of Management and Budget to sign off on (or to send back to FDA requesting changes), which is required for all new federal regulations before they can be officially proposed.
OMB typically signs off on (i.e. approves) new regulations several months before they are officially proposed.
Thus, I'd be surprised if the FDA's "deeming" regulation is proposed before May or June (if its ever proposed at all).
And since Mitch Zeller just replaced Lawrence Deyton as Director of the FDA's Center for Tobacco Products, I strongly suspect that Mitch would want to carefully analyze whatever draft deeming regulation (and other e-cig regulations) that were drafted under Deyton's leadership.
I'd still like to know why the FDA decided to replace Deyton with Zeller. Margaret Hamburg's letter announcing Deyton's resignation also announced Zeller as his successor, indicating that Zeller had been chosen as Deyton's successor before Deyton resigned, indicating that Deyton was forced out.
