More than likely, the were referring to the FDA vs. njoy case - oral arguments in the appeal were set for TR. Once the appeal is settled (can the FDA continue to block imports while the main case is decided) the case will go back to Judge Leon for the determination of whether or not the FDA was stepping outside it's authority when they started blocking imports.

Now, the case may very well have a side effect of classifying PV's and sticking them into a regulatory scheme, but the article is VERY misleading, in saying that the whole shooting match will be over TR. The panel of judges on the appeal's hearing have no set deadline to render a decision. It could be weeks, it could be months.

I did like, however, that the article stated the FDA wants PV's regulated the same as tobacco :) If that were the case, the issue would be moot, as that's the position njoy has been arguing for a year and a half now...

Really wish reporters would ACCURATELY report things, or ask questions until the DO understand the story.

Yeah, but maybe we should start repeating it until it "becomes" true. Isn't that what they're trying to do to us? ;)

Trouble is that if people think it is going to be a tobacco product, then the de-facto ban goes through with no debate. The troops will all be in their bunks when the attack begins. I think that everyone needs to know the BS the FDA is trying to pull.
