I have seen many posts recently that we need to fear the state regs and taxation schemes more than the FDA deemings ( at least until the full imact of the FDA deemings is realized in 2018 ). That led me to do a little research to see if i can find the current status of ecig regulations in different states in one document. I don't know how accurate this is, and keep in mind it has been collated by a tobacco control program ( Public Health Law Center at Mitchell Hamline School of Law ) . So while we look at this as disastrous, they look at it as a start, but proof that a lot more needs to be done !

Good to know! Thanks for posting, my state has it as non tobacco!
These are the states that have ecigs included in the definition of "Tobacco Products" in at least one section of the state’s statutes. Just a quick glance, could be more.

Minnesota
South Dakota
Wyoming
Utah
Colorado
North Carolina
West Virginia

Michigan, where I live, is vaping perfection. No State laws of any kind related to vaping. A few localities have a few rules which were either unnecessary or ignored. I did jury duty in the Federal court in Detroit a few weeks ago and vaped my way through it in the jury room. That's truth, justice, and the American way, the Michigan way.

States that didn't participate in the MSA and so aren't depending on those funds for current and future revenue:

Florida
Minnesota
Mississippi
Texas

It will be interesting to see how things go with them. I am looking to find a list of states who have sold tobacco futures bonds. They will likely be looking to protect smoking by taxing vaping punitively or banning it to the extent that they can.

Couldn't find the list of states immediately, but apparently it's eighteen states and D.C. as of 2010.

By 2010, eighteen states, the District of Columbia, and three U.S. territories securitized some or all of their revenue entitlements from the MSA payment schedule into bonds. The issued bonds totaled $40 billion and are backed by expected future MSA payments.

To make up revenue I can see Ms and Al both doing it
I could see all States doing it sooner or later.

Don't remember where i heard this but it said 31 States were in financial distress.

They are actively looking for other sources of revenue.

Read the link you posted. It's specifically for tobacco products.
Here is what is on the books concerning e-cig tax in Minnesota.
You'll notice the 95% wholesale tax rate. Read it carefully.
Minnesota tobacco wholesalers never sold e-cigarette products.
still don't as far as I know. This law is from 2009. It refers to
cigalikes only. Two new laws attempting to close the loop hole
were pocket vetoed with out over ride and no apparent hue and
cry from all of the usual subjects.

E-cigarettes

As of today the only tax paid on e-cig products is the states sales tax as with everything.

Minnesota wholesalers are responsible for state tax collection of tobacco products.
who ever brings them in sate are responsible for federal taxes. Same as alcohol
I beleive. Not 100% sure.
