Urgent New York - Rosenthal at it again! This time, a purported public use ban.

Unsurprisingly, based on Rosenthal's two utterly stupidly written previous bills aimed at outright sales bans, this proposed statewide use ban is also ridiculously written, such that in it's current state it fails to effectively ban vaping in public, even though that is its sole intended effect.

But, this proposal's very existence is hugely threatening, because if other, perhaps smarter New York legislators decide to support it, the problem with its current language could be easily rectified.

And a possible New York statewide use ban would be just as disastrous for the whole country as would a California use ban. It would be a horrible precedent and inspire other states to follow.

For further reference, here is the current smoking ban law in NY: State of New York - Regulation of Smoking in Public and Work Places. Rosenthal's proposed amendment simply sticks the phrase "including electronic cigarettes" into the existing definition of smoking.

Assemblywoman Sandy Galef is pushing legislation that would categorize electronic cigarettes, or e-cigs, as conventional smoking along with cigarettes, cigars and pipes. The bill is still being drafted, but would add the product to health law banning traditional forms of smoking.

So, Galef's bill is still in the drafting stage, but she grants interviews about it? Looks to me like she's coming to us from the "Legislation by Press Release" ANTZhill...

to fund, support, and cheer-lead all of them on.
